hello.

well bad news but still i am not sure about it? or what it mean !!

well days ago we called our congressman and we chat with his secretary and we told her about our I-130 it's been pending since we start it and since that date we heard nothing about it ! and his secretary said ! that she will take care of our case, why still pending since we start the papers and for sure it's been 3 years since we start it! well today we received a call from the secretary she Said! " I sent a message to the immigration ask them the reason why still this case pending till now ? so they told her, the reason this case pending cuz this case in the FBI hand ?!!! and this what i dont understand! What does this mean by "FBI" what i did to my case transfer from immigration to FBI. thats mean must be something wrong ! and how can be wrong and i am here in the usa already on K3 Visa. if i had done something bad before they will not give me visa from my country to usa and they will not give me SS# and Work permit, and also my visa soon gunna expire and i have to file for an extension but the thing is ... if my papers pending in the FBI 3 years when can we get approve on it or how can we figure out !!! anybody can help out or give me an advice !!

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

If your here on a K-3 visa already, does that mean your AOS is still pending?

FBI is the Federal Bureau of Investigation. One of the federal law enforcement branches. They also do name and background checks on those people applying immigration visas and those adjusting status. For most people this goes pretty quick. But if you have a common Islamic name for example, it can take quite awhile.

but it's been 3 years pending !!!! cant u see this is alot ??? beside some people i see got approved on their i-130 within 2 or 3 month ?! and if u think it goes by names! why did they gave me the Visa ?! they sould to tell me Sorry !! right ?

you will have to be more spacific. is your AOS pending? If your here in the united stated already on a K-3 then nothing should be pending on it. If you came here on K-3 and have applied for green card then yes it is possible to be pending for 3 years. My husband has been pending AOS or in other words his green card since jan, 2005.

Not everyone on a K3 does adjustment of status. It's fine to return to your home country for the CR1/IR1 interview and return on that visa to produce a green card. I am guessing this is what the OP was intending to do and they probably haven't filed for adjustment of status.

To Sand - have you filed a I-485 for adjustment of status? That is better than going through the hassle of sorting out the situation and getting an extension. I would recommend filing it as quickly as possible and then you'll avoid troubles with any overstay. You may run into a similar problem when adjusting that you have with the I-130, but at least you'll be legal still.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
