I’m trying to do my taxes on turbo tax and I am getting confused by contradicting information. We plan on filing married jointly. Even though my husband does not have his green card yet, he qualifies for the physical presence  requirement in the past three years so I believe that makes him a full time resident. He also has a SSN. He has no income to report in the USA nor his home country, since he has not received GC/work permit yet. Should I just file MJF and put him down as full time resident unemployed 0 income? I don’t need to send in a separate letter if he is considered a resident due to the physical presence requirement, right? I just want to make sure I do everything correctly, but it seems too easy??

Yes.  That is exactly what I would do, based on your post.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The tricky part for first year filing tends to be

  • No SSN yet so needing an ITIN
  • Foreign income earned during the tax year to report on a joint return
  • Spouse not meeting physical presence or green card test so needing to file an election statement to be resident for tax purposes

You don’t seem to have any of those issues, so carry on and feel lucky. There’s no extra hoops to jump through to file a joint return.
