I currently hold conditional green card. I will file the removing condition on my green card on August. I would be eligible to apply for US citizenship in November 2008. I wanna bring my brother into America to study. My brother is only 13 right now. Can he come here as an nonimmigrant F-1 visa to study and then I will file the petition for his immigrant visa?( I know that it's gonna take at least 10 years to in order for his immigrant visa to be reviewed). If you are a green card holder, can I petition for your brother to come to america or u have to be US citizen to petition for your siblings. The other option i could think is filed petition for my dad to come over here. And my brother would be eligible to come with my dad to America because my brother would be immediate benefitsary from my dad. Do u have to wait until you become US citizen to file petition for your dad? or if u have a green card, you can file the petition for your dad too. i don't know what is the best option to bring my brother over here. Please give me some advice. My parents wouldn't like to stay in America, they only want my brother to come here only.

You need to become a U.S. citizen to petition your brother or parents.

I have no idea if your brother will be eligible for follow to join benefits if you file for a green card for your parents. I couldn't find any information on that. Maybe somebody else on VJ knows?

I have no idea if your brother will be eligible for follow to join benefits if you file for a green card for your parents. I couldn't find any information on that. Maybe somebody else on VJ knows?

A separete petition is required for parents (one for each) and siblings. No derivates, follow to join ...

So i have to be american citizen to file petition for my parents. and then my parents can include my brother in the application if he is young enough right?? Do u know how long does it take to file petition for my parents.

No, you petition him as a Brother.

No wait for visa number, just the usual processing time - say a year. But presumably they would not leave your Brother behind?

So assuming that I will be US citizen in January 2009. I will petition for my dad to come over US. On Jan 2009, my brother is gonna be 15 years old. How long is the process to petition for my dad to get a green card? Can he bring my brother over US when my dad come to America. Or my dad come to america first and then petition for my brother to come over US later. Can my dad and my brother come to the US at the same time?

you will have to file for both your brother and father at same time and one might get approved before the other i am not sure but i thnk you need to be permenent resident to file

Your Father, usually within a year, there is not wait for a visa number.

You can petition for your Brother, your Father once he is a LPR can petition for him.

It will take a long time, how long depends on which country.

The only way they could come at the same time is if your Father waits for your petition for your Brother to be current.

Sponsorship for a sibling or your dad can only be done after you become a US citizen. Depending on the country it can take over 10 years for your brother to get the green card, so while filing for him after gaining your citizenship, Once your dad gets here, He can file for your brother(his son) and you can be his cosponsor for your brother.

Firstly you should become a legal immigrant.as being a legal immigrant you'll become a foreign national who has been granted the privilege of living and working permanently in the United States.The process of naturalization will be much simplified then for your relatives. There is a two-step process for your parent to become a legal immigrant. First, the USCIS must approve an immigrant visa petition that you file for your parent. Second, if your parent is outside the United States, your parent will be notified to go to the local U.S. consulate to complete the processing for an immigrant visa. If your parent is legally inside the U.S., he or she may apply to adjust his or her status to that of a lawful permanent resident using the Form I-485.
