Below is our checklist we are getting ready to send but I want to make sure it has everything we need or if there are items here they do not need yet .

Does line #5 need to be included yet or is the I-864 done later, if so... how much later? 

is this checklist the right format as well?

Subject: I-130 Petition for my spouse BENEFICIARY'S NAME (Original Submission)

Dear Sir/Madam:

I, “Petitioners Name”, a citizen of the United States, would like to file a petition I-130 for my spouse, “Spouses name”


Please find enclosed the following required and supporting documents: 

  1. Check for I-130 filing fee
  2. Completed and signed form I-30 
  3. Completed and signed form I-130A 
  4. Completed and signed form G-1145 
  5. Completed and signed I-864 A from myself the PETITIONER and MY friend/ employer who will be the beneficiary’s CO-SPONSOR.
  6. Most recent IRS federal tax return and w-2’s from both sponsor and co-sponsor 
  7. Co-sponsor owns a business or has partners so he is including one of these forms along with his federal tax return: Schecule C (profit and loss from business) or schedule D (Capital Gains) Schedule E (supplemental Income or Loss) 
  8. 2 photographs of petitioner 
  9. 2 photographs of beneficiary 
  10. Copy of my birth certificate (2) If you include this, your passport copy is not needed if your birth certificate is from the US; if it's not a US birth certificate, it's not needed at all.
  11. Copy of petitioner passport If you opt for this, then you don't need the birth certificate copy; the purpose of this is to establish the petitioner's US Citizenship and one item is all that is needed.
  12. Copy of benificiary passport Not needed at this time
  13. Copy of our marriage certificate original and translated
  14. Copy of divorce decrees petitioner  
  15. Copy of divorce decrees beneficiary original and translated
  16. Copies of affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of our marriage. (2)  Skip these in favor of evidence of time spent together in-person; such affidavits carry little to zero weight in the overall evaluation of a file.
  17. Photos, passport stamps, hotel receipts, boarding passes, train tickets for 2 years.

Also Since, I have lived outside the USA for over two years now, is phoenix AZ where I mail this petition to ? Or Chicago or Dallas? My legal residence is still Colorado Springs Colorado.

5, 6, 7 will come at the next stage, post petition approval. You don't need to send it with your I-130.

You don't need the beneficiary's passport and photographs either
