AOS Petitioner income for Affidavit of Support, Sponsor unemployed

Timeline

Has anyone gone through the AOS process with the condition where Petitioner's income was used as joint sponsor on Affidavit of Support? Sponsor is unemployed but has enough joint savings though. Just wanted to know the interview experience and what documents should be taken along, just in case it is asked "what if you lose your job?" , maybe savings can be used as a backup plan then?

To clarify, are you the immigrant and asking if you can sponsor yourself jointly? If so then no. You can’t “support” yourself. A sponsor has to be a us citizen or lawful permanent resident.

 

You stated the sponsor has enough in savings. The savings must be 5x over the poverty guidelines for your household. It does not follow the 125% of poverty guidelines. In addition if you are using assets (savings account) you must submit 12 months of bank statements. They want to make sure someone didn’t just give you 100k to make your savings account look good.

 

 

 

Joint Sponsor

A joint sponsor is someone who is willing to accept legal responsibility for supporting your family member with you. A joint sponsor must meet all the same requirements as you, except the joint sponsor does not need to be related to the immigrant. The joint sponsor (or the joint sponsor and his or her household) must reach the 125% income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement.

Thanks Luckycuds. I think we can demonstrate 5x of 125% of poverty line in savings if required. I found on I 864 instructions that I / immigrant can used as a sponsor only if he/she is a spouse of the applicant. Works for us. But was concerned what are any specific questions that may be asked in AOS interview about it.

Yeah I've seen that happen :( good to always keep insurance. And that's not the only way you apparently lose money these days, people get sued for weird reasons (rare scenario, but can happen)
With annual income I can prove a steady and good economic condition, wondering if I should carry our joint savings etc. to show that we have been responsible and working towards a goal.

Btw, I have been working here, so not for consular interview but AOS interview in field office.

I'm sorry, but everything you wrote here looks really confusing.

 

First, forget the names Petitioner and Beneficiary. Those are terms used only for the K1 visa process. For AOS, the foreign spouse is the Applicant and the US Citizen spouse is the sponsor (main sponsor if there's a joint sponsor involved).

 

Second, let's try to understand what's going on.

 

You are: Foreign Spouse (?)

 

If so, Is your US Citizen spouse unemployed right now?

 

You're saying you have the money 5x the poverty line. Where did the money came from? From the US Citizen or from you the foreign spouse?
