citizenship application deny my N 400 application

 I came to American with fiancé visa and I got my permanent green card 2015 with my real name . After been with my wife for five years we decide to file application for my citizenship. Submitting all the document they requested from me and been to interview 2 time and they find some name and date of birth that have been use by my parent to file green card form me back in 1992. And also  when I came back to the US 1996 and this time without proper document and I apply for asylum and it was denied and I was deported back to my country 1998 . In  my N400 application has been deny base on past name and date of birth been use back in 20years ago. According to the letter send to my by USCIS says that base foregoing information ,I have committed fraud and misrepresentation and am not lawfully admitted for permanent resident in the U.S. I have been giving 30days from the date of the notice to submit either a rebuttal or evidence to show that you can overcome the reason for denying my application. Failure to response to this notice within this time will render me ineligible for naturalization and will result in this denial of my application. Can anyone please help me on any can of advice on what to do to solve this mysterious problem ,This been giving me issue and  I don't no if this will affect my permeant green card that I have now. Thanks for all you support.

I would find a competent attorney asap.......this could have affects other than just your naturalization.......not a DIY case, imo.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Wow! I am surprised you've been in and out so many times with this history but anyway I second the need for an immigration attorney. I don't see where you have any other option.

Knowing your sordid (no disrespect intended) immigration history you should never have applied for citizenship, but that’s water under the bridge.

 

My advice is get off VJ immediately and retain the services of a competent immigration attorney with deep experience in fighting removals because that is what is going to happen to you.

 

This not a Do-It-Yourself project. This is for the big guns, ie immigration attorneys (and not just any immigration attorney). It will be money well spent.

 

i have done enough research on removal cases to know you’re facing an uphill battle, even with the best immigration attorney.

PS: Google and read up on Operation Janus and Operation Second Look. Many already naturalized citizens are having their citizenships revoked and put in removal proceedings for exactly this same issue, and I’m talking people who unlike you had already finished the citizenship process and been citizens for sometimes decades.

Not sure why it is ‘mysterious’ (and why did you even mention using your ‘real name’ in your post)?

 

Immigration benefits obtained fraudulently can be revoked any time.

 

Time to lawyer up.

The presumption is that you forgot to mention your prior dealings and change of name when you obtained a GC.

 

If this is the case then yes I would anticipate serious consequences.

So I am trying to read between the lines. Your parents tried to obtain, in some manner, a green card for you under a false name, not sure under what category they attempted to obtain a green card for you or how you arrived in the US that time. Then you came to the US again either without inspection or with false documents, probably using a fake name, and tried to obtain asylum. I seriously doubt you disclosed either of these two events on your K-1 paperwork or during your interview. 

You need a top-notch attorney and even then your chances of remaining in the US are very, very slim. Is your wife prepared to go live with you in your country?

yes she is ready to leave any were with me ,if that answer your question

As above. People have been denaturalized for this. By all means retain an attorney and hope, but it’s probably wise to start making contingency plans to leave the US and build a new life back home.

Out of curiosity: With everything being said isn't OP now facing a lifetime ban from the US once leaving?

08/16/19: sent I-751 packet to USCIS Lockbox in Dallas

08/19/19: packet received by USCIS

08/21/19: received text message with case number ( Texas Service Center)

08/23/19: check got chashed

08/26/19: received extension letter in the mail

11/14/19: Biometrics appointment

04/28/20: case got transferred to my local field office in Atlanta

05/28/20: New Card Is Being Produced

05/29/20: New Card Got Approved

06/02/20: We Mailed Your New Card

06/03/20: The Post Office Picked Up Your New Card

06/04/20: Card Was Delivered To Me By The Post Office

That is correct.  OP is in one of the worst possible categories of immigration offenders and undesirables. He could conceivably be excused for not mentioning the fraudulent procedure initiated by his parents when he was a minor, however that second case where he claimed asylum and was denied and deported under a different nail essentially ends any chances of leniency.

I don't know that a hardship waiver would apply to misrepresentation........it will be a very tall mountain to climb, imo.......

Chances of him staying are very slim since he probably didn't disclose ANY of what's stated in his opening post in ANY application. 

 

Best advice would be to get ready to leave the US forever.
