Hi,

 

I am Pakistani passport holder. I became Canadian Permanent Resident on 5Oct2014 in ON, CA. I meet residency obligation of Canadian Permanent Residency. My PR expired on 5Dec2019. I didn't check and left Canada on 20Jan2020. Flight staff didn't allow me to return on 13Feb2020 from KHI, Pakistan.

 

QUESTION: Is it worth trying for USA Visit Visa (for the first time) based on previous examples in the past so i depart from PK, land in USA and cross USA/CA land border by road on personal transport using expired Canadian PR?

 

I assume Visit Visa processing time in KHI, Pakistan will be 1 month (as mentioned on the website)!

 

Humanitarian grounds:

I came Pakistan to see my mother suffering with fatal liver cancer. I need to return to Canada ASAP because my C-section surgery is scheduled for 26May2020. I am pregnant 27 weeks and flights will not allow me to board after 4 or 5 weeks from now. I am controlling my diabetes using insulin. My born Canadian son 2.5 years having diarrhea. My 8.5 years old daughter attending school in Canada regularly and staying with my husband. I have submitted Permanent Resident Travelling Document (PRTD) application but processing time is 2 or more months.

Attachments & Proofs:

I can attach Surgery appointment, Dr letters showing pregnancy complication and residency obligations, Return ticket - though ideally will use one way and cancel the other but just for the backup and satisfactory of US visa officer, bank account statement, credit card transactions, daughter school attendance record, husband employment letter, home rental agreements, Canada Revenue Agency Notice of Assessments for 2017/2018, Canada Child Benefit, Confirmation of Permanent Residency (5Oct2014), Canadian driving license/expired PR Card/health card/Son's Canadian passport,Volunteer ship letter (teacher) etc.

Where are you currently and where are you trying to go?  

 

Unless you already have a US tourist visa, it will be easier to follow IRCC instructions

 

If you do have a US visa already, then make sure you have all your documents in order (expired card, correspondence from IRCC, etc.), and, ideally, have a Canadian friend pick you up in the USA to return to Canada. Note, getting a Travel Document from the USA is not faster and only done at one, or two, consulates.

I think your chances of getting a US B visa are very small, you can’t show any ties to Pakistan from what you’ve described, and having an expired Canadian PR is not going to help convince them you can leave the US either. Best try see if you can somehow expedite CanadIan document.

Why would you try to go about getting back to Canada by getting a US visa?  Why not apply directly for a Canadian visa?  Seems sketchy to do it this way.

I am in Karachi, Pakistan. I want to go to Toronto, Canada finally via USA by road. so PK to USA to CA. 

 

I thought strong ties in Canada & PRTD application submission will show that Canada is the destination and that there is no reason / benefit to stay in USA. Pregnancy situation should show no interest in adventures too. BUT i understand...you may be right...chances are less.

 

Canadian PR holders cannot apply for CA visit visa.

Can you explain why you think the US would give you a visit visa to transit them on an expired Canadian PR?  It is totally not the purpose of a B visa, a Pakistani national applying from Pakistan is expected to show ties to Pakistan, and in my opinion all your ties to Canada will do is make them tell you to wait for your Canadian documents.


by the way - What happens if you are refused entry at the land border? Why do you think this will work? 


I mean, you only have $160 to lose by trying but I think your chances are tiny.

No harm in trying.

While I get what you are saying about being a PR of Canada, the CO likely won't look at any documents or that fact. They will look at just what is on the DS-160 and as a couple questions.

Ok, it seems there is a road workaround using a private vehicle. I wonder if it’s worth applying for a C transit visa rather than a B visa. Not sure how that works if there is no booked carrier transport onward though, they may or may not accept a rental car reservation as proof of onward journey.

I think you should put your efforts in having the consulate expedite the treatment of your travel document in Pakistan.  Submit doctor letters (from your ob-gyn, mother's doctors, etc.), school documents, etc. Be polite and clear in your request, do not overjustify, but admit that it was your decision.

I understand you want to return quickly, but you still have some time before delivery - do not overstress yourself and realize that you took the decision to travel and any time spend together is worth the little hurdles now.  

 

[Travel documents have/can be issued in a few hours, so asking for a couple of weeks is reasonable]

Hi Yes, you can enter via private car (please check on the cic.gc.ca) with an expired PR. Get ready to be questioned a lot but that is the only way except you apply for a renewal and wait until the card is mailed to you. I have a friend who did this recently that's how I know. She flew to Buffalo on a US Visa and her mom drove to Buffalo to pick her up. Just account for the extra time at the border and check the CIC website.

 

 

Sorry just wondering - why not just renew your PR card? The process doesn't take too long and I believe you can put a rush on it.

So to help the OP, can you expand on whether your friend already had the US visa, or whether she got it just for this purpose? If the latter, what the US embassy required to issue the visa to her.

My friend already had the US visitors visa. She lived in Canada and travelled out without renewing the PR (same as author of the post, she forgot to) she was denied entry into the flight from Russia - Toronto on the basis that her Canadian pr card was expired. 
after some research, she ended up booking a 1 way ticket to buffalo NY on an existing US visa and she was able to come in to Canada via private / personal car (her moTher)

 

it may be a different process if you are getting the US visa just for this case... and I’m sorry I have No insight

 

 

i just checked the Canadian site and the fee to renew or: $50 and the processing time is 25 days.
I renewed my PR last year and it didn’t take a month. I strongly suggest doing that and having someone mail you the card over there. @FaniKhatakaar
