Hi :) We got our first RFE today! Eek. Following filing our adjustment of status paperwork. 

They are asking for us to "submit a complete federal income tax return submitted to the IRS for the most recent tax return. If you submit a transcript it must be a tax return transcript from the IRS" 

To clarify they mean the transcript you can get through here?

We did submit the most recent but maybe by the time they came to look we had done our taxes again. So is that all we need to send through? Im probably going to send the most recent w2 and payslips again just incase.

I don't think they are requesting the 2019, since many people won't have filed until the April 15 deadline.

I submitted 2018 but maybe i'll just include that again and 2019 to be safe?

Yes, and the transcripts are preferred.

A couple of people in the December 2019 AOS thread received a RFE for the most recent return/ transcript though that they had sent the 2018 one. Something weird is going on at USCIS 🤷‍♀️

Yeah i saw that also. Its a little annoying since it will add time to the process but as long as it all gets sorted I'm happy :)

Usually RFEs worded that way means that your 2018 tax return submission did not include all the elements to be considered “complete”.  Complete would be a photocopy of every page of every Form and Schedule in the return PLUS the corresponding W2 or 1099 showing the wages.  If you will get the 2018 transcript from the IRS, then you don’t have to worry if you had all the right pages and W2 statements.  The transcript is complete by itself.

 

2019 taxes are not due yet so the USCIS can not require them.  If you have filed already, you can put together a 2019 “complete tax return”—-all forms, schedules, and W2s/1099s.  

Do not send:

  • a tax return without the W2.
  • a W2 without a tax return.

Both of those would be considered incomplete and would get an RFE.

Do we need to send the 2016 tax return? My husband doesn't have his W2 from that year? We have all our stuff for 2017, 2018, 2019 though

 You only have to send the most recent (2019). The two before that are optional if you think they make your case look better. 2016 is not needed.

Since the 2019 tax deadline has been moved back because of Covid19, does that mean I do not need to provide 2019 taxes with the Change Of Status paperwork if I have not completed them? Will they accept only 2018 along with my W2?

A paper tax return is not complete unless it has the wage statement with it (W2 or 1099).

A tax return transcript from the IRS is complete just as it is without a W2.

 

A paper return is just your word unless the W2 is with it to verify the income. You could fill out a fake return. A transcript is verified because it comes from the IRS.

 

The  required “most recent” tax return is 2018 until the filing deadline of July 15 passes  Immigration can not make you file early. However many have already filed 2019 so would use that as their “most recent” because It is already filed.
