Hello,

 

I am a USC and planning to apply GC for my parents who live in India. I have the following questions

1) does the form I130 have anything to do with public charge ? is this form going to change on 24th Feb ?

2) Once I130 is approved, what is next ? the uscis website says , "You will be notified by USCIS if your Form I-130 petition is approved or denied. If it is approved and your parent is outside the United States, he or she will be notified to go to the local U.S. consulate to complete visa processing." I am sure it is not that simple. are there better instructions ?

3) After I130 is approved how much time do we have to complete Visa processing, can it be after a few years ? or is there a timeline ?

4) While I130 is pending, can they travel to the US on their visitor visa ?

1) does the form I130 have anything to do with public charge ? is this form going to change on 24th Feb ? I believe that only the affidavit of support (I-864) and supplemental forms are changing.  Like all immigrants, they will be subject to public charge rules.

2) Once I130 is approved, what is next ? the uscis website says , "You will be notified by USCIS if your Form I-130 petition is approved or denied. If it is approved and your parent is outside the United States, he or she will be notified to go to the local U.S. consulate to complete visa processing." I am sure it is not that simple. are there better instructions ? If approved, they will have an interview at their local consulate.  

3) After I130 is approved how much time do we have to complete Visa processing, can it be after a few years ? or is there a timeline ? Are you a USC?  Timelines vary based upon visa category, which processing center the petition ends up at, and consulate variables. 

4) While I130 is pending, can they travel to the US on their visitor visa ? Yes.  As always, there is no guarantee of entry.
