Hi my son met a girl on line and went to usa on an esta  10 months ago, he has decided that he is going to stay in the usa and will be getting married, obviously this was not the right way to go about this, any advice as to what he can do now he will not leave usa as he knows he will not be let back in, he cannot work as has no visa or anything .

he has not got married as of yet.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

He can stay and adjust status. He should join here and study the guides. Old enough to get married, old enough to sort out his own immigration stuff. Since he’s not working it’ll give him something to fill his time. I know you want to help but many mistakes have been made by well-meaning friends and relatives who don’t understand the process and confuse the information. 
 

The sooner he files the adjustment, the better. Currently he is out of status and can be deported at any time. His overstay so far already gives him a 3-year ban.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

He has no path to legally stay until after the marriage has occurred

I missed the part that they are not married yet. They must get married ASAP if he is to stay. Quick courthouse or Vegas wedding will do the job. Doesn’t have to be big or fancy. Time is not on their side.

If his I-94 has expired, he should marry and file for adjustment of status asap!!!  Marriage, alone, will offer no immigration benefits.........
