Hi all. I am having a problem, the USCIS has now asked me for new documents for a second time. Its regarding my Canadian birth certificate. Basically my "birth certificate" is only a certificate of live birth, but I've asked my mother and she says that is the only document she's ever have and claims it is my real birth certificate. I was born in Ontario.

 

I've attached a copy of nearly the same form I have. Its hand written and slightly different because its older. I've started the process to get a copy of my birth certificate sent from Ontario but my mother still swears up and down I will get the same document. While my wife swears up and down that the document I have is not my birth certificate. Edit: I should add that the document is stamped.

 

I've also sent the same document to my lawyer twice and they sent it off to USCIS without batting an eye.  It's already been 7 months and now it's getting annoying that this paper is holding my status up. 

 

Anyone gone through the same thing? Appreciate any advice!

Go to your registry and request for your long form birth certificate. I had to have it for my kids when registration then with the US Consulate as foreign born citizens.  It’s a sheet that has your birth weight , time of birth , dr , all of that.  You don’t need your mom to get it -just go to the registry with two forms of ID.

 

Ok so editing -looks like what you have is the one I’m talking about. Not sure why they won’t accept that ...very strange.  However just request a regular birth certificate then and hopefully that will work.  Here in Alberta they are a small paper with name of parents , your name, and birth place ...maybe that’s what they want ??  Other than that I’m lost

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Ontario has 3 types, short form. Long form. Live birth.  Normally you need live birth but i would order long form too with just parents names etc.

I was born in Ontario as well and submitted the certificate of live birth (what you have above) for both my K1 process & interview, and my adjustment of status for permanent residency (green card application).
For the K1 process I had no issues with that... When I applied for permanent residency they sent me an RFE for my birth certificate (even though I for sure included my birth certificate in my package and they have copies of it from my K1) and I sent them the exact same document I had included with my original adjustment of status package - and they accepted it no problem, even though it’s the exact same thing I sent them originally. Try resending the same document to them again, perhaps they misplaced the one you submitted? Sorry to hear you’re having this trouble.

This is the second time they've sent a RFE in regards to my birth certificate. I've requested a long and short form birth certificate and will send them both in. Hopefully they will be here soon and it will move along the process. Thanks for the advice.

Ordered both short and long going to resubmit with all 3 and see how it goes.
