Hey Guys/Gals, I have few questions about joint-sponsor...

 

At consulate (IR1) interview beneficiary was told to get a join sponsor. Husband (USC applicant's income is fine, but it looks like he may have sponsored a bit too many fiends), so the need a joint-sponsor. My questions are:

 

a. Let's say the applicant sponsored and still is liable for 3 friends, does the co or joint-sponsor's income need to be enough to sponsor 5 folks (applicant + applicant's 3 friends + beneficiary) OR does he/she need to make 125% above PG for just him/herself + beneficiary.

 

b. Note that couple have a newborn who was just approved and issued a US passport last week at the consulate. Does the joint-sponsor need to make enough $$ to support the mom (beneficiary) + newborn?

 

c. Finally, does the co or joint sponsor need to submit tax transcripts for past 3 years or just 2018, assuming his/her 2018 taxes are amply above the guidelines?

Imo You  are  responsible for your 3 friends until they become citizens or  they earn 40 credits ( 10 years of work history ) or they abandon their green cards . So if you are able to pass citizenship to your newborn , your household size would be 5 ( your 3 friends , you and the beneficiary )

1) They only need to be able to sponsor their own household size (counting the intending immigrant).

NOTE: The applicant's 3 friends has no role in the process. The applicant is the alien applying for the visa. They are both the visa applicant and petition's beneficiary. I think you mean petitioner.

NOTE 2: The 125% level is a minimum for consideration. Under = no visa. Over = judgement call. Focus more on what is practical to support all people in that sponsor's household, not the minimum income level.

 

2) Is this the joint sponsor's child or the petitioner's child?

If it's the joint sponsor's child, then yes the child is counted in the joint sponsor's household size.

If it's the petitioner's child, then they would not be included in the joint sponsor's household size.

 

3) They must submit at least the most recent year's tax transcript. The other 2 years are optional.

This is separate from showing evidence of current income. Unless self-employed (where tax return = current income), they also need to provide evidence of their current income, such as pay stubs.

Passing citizenship to the child would not matter. Any biological child under age 21 (or age of majority in their location of domicile) must be counted in the household size.

I met the income requirements and my fiancé was still told we needed a joint sponsor at the interview. Casablanca is just a really tough Embassy. I wasn’t able to find a joint sponsor so I’ve just submitted my new tax transcripts for this year since I made more money and I’m hoping it’s enough.

If the CO said a joint sponsor is needed,  that is all they will accept. 

At present it would be 2018 well above the guidelines/  they do not have to accept the bare minimum

I’m $10,000 above guidelines. My lawyer told me it would be fine to submit new taxes for this year. It’s so complicated. Everybody seems to have different information. I have no idea.
