Ok guys, here is my update and I wanted your opinion and advice! My D will be final next week (around June 20th ish) I am toying with the idea of having Sam come here for a visit in August from India. He has never been here before and I think it would be a good introduction to the U.S. before he comes here permantely after everything is approved via K-1. It will also establish more evidence for our relationship for the K-1.

Here's my dilema, my new place is under construction and it won't be ready till late July ish. When should I start filing for the K-1 Visa? I already have my new address but haven't moved in yet obviously but want to make sure I get my mail hehe. Is it ok to apply for a K-1 visa at the same time of a B-2 visa? I know for the B-2 visa I have to fill out an I-134. A few of you mentioned tax returns for support but my tax returns were filed jointly with my ex. Is that going to be a problem? Does Sam need to get shots for a B-2 visa? What should Sam put down for his reason of visit? Visiting, friend, girlfriend, fiancee?

Please help, I'm a little ball of stress right now lol - all I want is to see my man. :unsure:

1-09-2009 - Received NOA2 e-mail notification

2-09-2009 - Packet 3 Received

4-08-2009 - Received visa!!!

I know for the B-2 visa I have to fill out an I-134.

Must be different than the Philippines as the B2 applicant is the one that has to prove financial capibility of making the trip and having GOOD reasons to return.

Finances of relatives and friends they are going to visit don't have anything to do with it.

Your going to have a very hard time getting a B-2 visa. Primarly because he doesnt have a job, and he has a fiancee here. The CO or border agent will likely suspect that your fiancee will intent to immigrate on the B-2 and will deny the visa.

If you do manage to get a B-2 visa, he will not be required to get any vaccinations.

It is highly unlikely that they will give him a visitor visa if he has no job, has no money in the bank, and does not own property. He has to show significant ties to his county. They will also know he has filed for a K-1 visa. They will think he will not return home. You can try, but I think it will be a waste of time and money. Good luck.

IF you have already filed a petition for a K-1 visa, they will not issue a B-2 visa. I tried it, with no joy. A couple of years ago, when the process was even slower than it is now, you could get a B-2 under these circumstances. But, no more. Don't waste your time or money, however it would be a good idea to start getting all information needed for the I-134 affadavit of support, you will eventually need it.

Date in India right now if you applied for visa.. VFS timeline is giving interview out now for August.. VFS website

showing dates of August 23-24 only... however if it was a b1-b-2 business visa the dates change.. to almost the whole month of July.. July 3rd being the earliest... VFS Calendar

Depend on your country, B-2 is not for everyone. Sorry to say that India is not one of the easiest ones.

I'll respond just about this part. My suggestion is to file for your K-1 now. Unless you can file through Vermont, you'll have a long wait, so why wait now and after you file? Once you get it in the system, you'll be glad you did.

As for your address, you can get a PO box or use a relative's address or just have your mail forwarded once you move.
