I-864A and Social Security Credits?

Hi Everyone,

 

I am a 28 year old, naturalized U.S. citizen working on petitioning for my stepmother to become a permanent resident. My family moved from Brazil to the U.S. in 2003 when my father got a job in the D.C. area that provides a G4 visa, so we all got G4s as well. My father is still working at this job so my stepmother is still on the G4.

 

I have a very specific question about social security credits and form I-864A. According to her social security account she has 35 credits as of right now, BUT she hasn't filed her taxes for 2018 and 2019 yet, which would put her over 40 credits.

 

My question is, if she files her taxes today, do we have to wait for the IRS to process them and award her the credits before filing her petition? Or can we send her petition in and use form I-864A showing proof that she will have enough SSC once the taxes are processed by the IRS?

 

I know it's a long shot but we would like to file the petition ASAP, and we would rather not have to file I-864, so I am curious what you all think!
