Hi All,

I am waiting for my 2 year conditional Green Card. I think it is clear to me what to do to get the 10 year GC after. But what are the requirements to renew the 10yr GC? I guess we are eligible even if divorced (not that I want to!!)?

You don't have to renew the 10 year GC if you don't want to, your LPR status is maintained as long as you remain in the USA regardless of whether your 10 year Green Card has expired. Renewing the card is merely a formality, its not the same as removing conditions on a 2 year card. You don't have to prove anything, and if you're divorced from the partner who got you the AOS in the first place, it doesn't matter.

A ten year Green Card is not like a drivers license, you don't lose the rights it gives you when it expires. The only issue with not renewing it is of course that you need a current card to travel, but even if your card expires I'll bet you could still get into the USA after being grilled by CBP.

I got my GC when I was 7 in 1983. My ex husband got stationed in Germany in 1994 and we were there for 3 years. When we came back to the US and went through immigration, they asked me why I had a pic of myself on there when I was 7 and no fingerprint. I explained that when I called the American consulate, they said it was okay. So, the immigration officer took me in the back and clipped a corner off of my card. She said she'd let me in but I could no longer use that card and needed to renew it.

*Came to visit me in Germany for New Years 2006

*Filed for K1 Visa on 4/4/06

*NOA1 - 7/6/06

*I-129F NOA2 Approved - 9/14/06

*Came to see me Thanksgiving week in Nov. 2006

*K1 Interview - 2/2/07

*K1 Visa received - 2/11/07

*Date of US Entry (POE Chicago)- 3/5/07

*Wedding/Marriage - 3/17/07

AOS (My case was expedited due to husband going to Iraq):

*Filed for AOS - 4/20/07

*Found out in the beginning of June that husband is going to Iraq

However, not having a currently valid green card in one's possession is a misdemeanor, subject to fine and imprisonment.

It costs $260 to renew a 10-year Green Card? Ridiculous...

It costs $260 to renew a 10-year Green Card? Ridiculous...

When i renewed mine in 1997 it cost me $75. $260 is waaay too much but then again, I feel the same way about the new fees that go into effect on the 30th of July. Really sad.

zackly. Even if you've been here legally 20 years, if asked for proof of legal residency and you don't have a valid green card, you can be put in jail indefinitely until they can determine your status.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Yes, this is true. However you don't lose your LPR by not renewing, is my point. I.e. you can forget to renew, then renew years later without issue (as long as you don't get caught!).

Shouldn't be that hard to determine our status. My friend looked my status up in the computer when I was in Germany - she works for HS.

whether it takes 10 minutes, or 10 days or weeks or whatever, I'd still rather not have to be taken away in handcuffs and stuffed in a holding cell just because I didn't feel like renewing my green card.
