Any more updates from old timers and younglins alike?

Not much new here. Things have calmed down a little, which is a good thing. We'll see what happens tomorrow. :wacko:

Keep the faith Charles. If it is any comfort to you, Bella has had her bags packed several times in the past year and if it was not for the kids, I would have gladly driven her to the airport! :dancing:

However, each time we pulled back from the brink and we are finally getting ready to file the AOS paperwork just before our 1 year wedding anniversary. :clock:

Can everyone take a look at the list of documents I am submitting for Bella and see if I missed anything? I have not done the kids' packages yet but they will be similar I guess. Do I need to duplicate the entire I-864 section for each child or can I refer to Bella's application?

FWIW... I think each sponsored individual needs an independent affidavit of support since each is a 'potential public charge' in their eyes. I believe there is space there to list the number of sponsored people right? Haven't looked at the forms in a while.

Everything else seems 100% a-ok.

I wrote to Byron a few months ago to see how he was doing. He said everything was great except for the small matter of Leidy (without AP) unintentionally going to Canada for Chinese food in a car with some illegal relatives and getting arrested when she tried to come back.

It sounded like everything was going to work out but yikes! :wacko:

Alicia & I are new to the area, but not the the Colombia site. For my wife is on the site everyday making new friends and talking to people each day. However, I am attending school at Fort Leavenworth, KS. Any advice you can pass on would be greatful as we are going through the AOS process would be appreciated.

I'm so sorry to hear that things aren't working out. I pray that everything works out for the best. Do you really want to help her to remain in the country?

Thanks for the good thoughts and your prayers. Things are day to day for now. But, I have no reason to deny her the chance to remain here. One of her dreams has been for her boys to be able to receive an education here (frankly, worlds better than what they would have in her relatively small home city).

As for things working out, I can only say that no one should ever underestimate the differences (and, therefore, difficulties in adjustment) in culture and family values that we see between here and Colombia. For now, we are at a truce. We'll see what tomorrow brings. But I would still like some advice or guidance on the issue of a divorced K-3 prior to AOS.

Now today, without an interview we recieved an email stating that they are ordering my green card.

Does anyone know if there is ever any leniency regarding a K1 who has been out of status for an extended time period using AP to return to the US after a visit home? We applied for AP but it sounds like she won't be able to use it. She entered April 1, 2008, we married June 27, 2008, and her visa expired August 28th, 2008. I think she went out of status 90 days after entry so that means she has been out of status for almost a year. From what I read, it appears that if she leaves the country she won't be able to come back due to the amount of time she was out of status even if she has AP.

Bill I STRONGLY urge you to reconsider letting her take a trip at this time until she has the green card. Hypothetically she should have no problem with the AP, if she gets it, because its a function of AOS, not of being passed AOS filing timing. In fact, she really wasn't out of status in the USCIS sense of being 'in violation' or anything like that because the K-1 has more to do with entering the US and she did... and you married within the appropriate timeframe. Nevertheless... do you really want her to potentially get held up for a secondary inspection that could take hours to verify that AP?

I could just be blowing this a bit out of proportion to be honest.

Good thing is that you submitted the paperwork. If you do travel... make sure she has the filing acknoledgement (the AOS NOA1) with her upon reentry in addition to the AP, etc.

I agree with Hal, it's best if she stays put until she receives her green card just in case. If she waited this long to file for AOS another 6 months won't kill her. Besides, if she does her AP approved she'll get in within 3-6 months, so she would have to wait just another 3 months for her green card. That's not a lot.
