Well everyone....I'm a wimp. I spoke with 4 diferent people at USCIS about our RFE. I got a diferent story from each person. The last person told me that they have Margarita's paperwork but nothing for Daniela. He thinks it got lost when it was transfered from Missouri to California. I'm too scared to standup for what's fair and right. I'd rather pay the extra $145 for another exam and play it safe. We went for Daniela's exam Wednesday, and I can pickup the paperwork on Monday. I just don't want to take any chances.

Damn John, sometimes i do wonder what the people at immigration are thinking. Why should you be the one to pay for their mistakes for losing the documents? That's similar to when they took the fingerprints for my wife, we had to go after a month because they said the prints were not taken accurately. But hopefully everything works out for you.

I'm also informing that my wife received her green card on Friday. Surprisingly, we never got an e-mail saying card production ordered or anything like that like we did in the past for the EAD. I guess since she had gotten the passport stamped, they assumed we already knew that the card was coming. Well this makes us USCIS free for a year and 9 months. Thanks for everything guys.

Time flys by quickly!!! I'm sure that some here are getting close to the 10 year GC process (I-751). I have been doing some reading a head and want to make sure I understand correctly.

Apply for removal of conditions 1 year and 9 months from the date of issue of GC or 3 months prior to the experation of the 2 year GC. Correct?

Under a K1 visa application for citizenship is 3 years from the date of the marriage. Correct?

That is a bit of a bummer cuz those dates are close to each other, have to pay more fees and go thru more hassel with immigration.

It has been a while since I have posted but have kept up with the site as a lurker. Things are going good for us. Paola's english is comming along good. She should be able to become employed as fobotomis (sp), thats a blood sucking, urine extracting position in a clinic by this fall and be able to continue to attend nursing school.

We most likley will be moving to southern Florida by August which will be a huge improvement weather wise for her and her son. They are not fond of the Seattle weather.

Feb. 2nd, 2007.....CSC receives NOA1

June 6, 2007........I-129F Approved

June 6, 2007........Cleared NVC and sent to Bogota

June 12, 2007......I receive packet 3 from our lawyer

June 14, 2007..... I send Packet 3 to Paola via FEDEX (2 day delivery)

June 25, 2007......Paola receives Packet 3 (9 days late)

July 3, 2007.........Packet 3 Fedex to Embassy in Bogota

July 5, 2007.........Packet 3 arrives at the embassy in Bogota

July 19, 2007.......Called NVC, interveiw scheduled for Aug. 17, 2007

July 31, 2007.......Paola goes to US Embassy in Bogota and gets Pkt 4 in person

Aug. 13, 2007.....Lab exam

Nice to see you around here again. We're also filing to remove conditions in July so I'll be posting the process for all others if they want to read it.

Yes, you need to file 3 months before her green card expires. That way you'll have her NOA in hand while her paperwork is approved. That NOA can be used as proof of her legal status even if her green card has expired.

She can file for US Citizenship 3 years after her first green card was issued, not from the date of marriage.

Good to hear from you Buck! I am happy everything is going well for you and your family. Yes time does not stand still. We will be coming up on our 1 year GC approval in September. I also will be moving to warmer surroundings when my wife completes college. Take care.

If she had all of her vaccines updated in Bogota, then you only need to get the Civil Surgeon to trasfer them on to the form and sign it. Call around to the CS in your area and ask. This should cost no more thant $25. If you keep checking in VJ, there is actually a doctor who will do this for you by mail.

Or it can be had for free at many local county health boards that just so happen to be listed as approved Civil Surgeons. We only paid for a couple of recommended boosters. $20 each.

It reminds me that any time you call USCIS, jot down times, dates, people you spoke to, and what they say so you can confront subsequent folks with factual, USCIS-provided information instead of with attitude (either passive or aggressive). This can help if you have to write an elected official or the Ombudsman.

Just checking in to let you know that we've heard nothing. Last week we were told that the officer that interviewed us had a death in the family and that she was out on bereavement. Our case is on hold until she returns to work. It appears our contact at the Ombudsman's office is out on personal leave as well. Just our Luck!

I guess a few more weeks can't hurt.

On Tuesday, I googled the address to the field office in Atlanta and got the phone number. I dialed random extentions until someone answered and asked about my case. They asked who interviewed me, I said her name and they transferred me to her extention. I left her a voicemail. I didn't get a call back, but I guess it can't hurt to remind her we're out here waiting. Today is one month since our interview. Don't know what to think. by the way...the ombudsman has been worthless post interview. I guess we're in 'NORMAL' processing time again.

Still waiting.

Hello all.... Long time since I've been here but things happen.

I'm writing requesting information for my wife. She has had her fill of this gringo and wants to leave. Her problem - and mine, by extension - is that we are still 11 months away from being able to apply for removal of conditions. From what I read here and on USCIS, as a K-3 visa holder and 'permanent resident', she cannot apply on her own for removal of conditions. Is that correct? If she divorces me, what options does she have to remain here ..... other than accuse me of abuse. :(

Of course, I hope that we can work things out but she isn't interested in counselling. Any help would be appreciated. At least I hope I can do one thing that will make her happy before she goes.
