Hi Guys!

Andres and I had his appointment yesterday and he was approved! The official took Andres' EAD and his I-94. Is that normal?

Anyways...She stated that he would be getting his green card in two weeks.

The appointment was relatively easy. She just asked how we met and requested our joint financial info. I gave her our 08 returns, joint bank accounts and joint credit cards. Thats it.

Relatively easy and quick. the appointment was at 8:20 we went in at 8:40 and were out by 9:10.

Andrea I hope you had good news yesterday! Please tell us you did!

Hola....went to the info pass appointment and they had no update for us...what a shock. Since we started the inquiry into our case 2 weeks ago, they said to sit tight for the 45 day period to get an answer. What a waste of time. At least the wheels are turning now and someone will pull us out of the bottom of the pile (where I envision our case file is).

Congrats to Andres and Diana on your approval...I hope your good luck rubs off on us.

Hello, guys and gals! I hope everyone is doing great.

I just have a question on Diana's comment: "and it will be good for 10 years" (the green card). I was under the imprssion that once someone became US citizen that was a lifelong deal, provided that individual met the requirements (continous presence, not leaving the US for more than 6 months, etc). I thought the 10 year expiration was for the card itself, not for the residence. Meaning after 10 years yes, you would have to maybe fill out a form and pay certain fees to renew your card, but your residence was good for your lifetime.

Was someone else under the same impression?

You're right. When an alien adjusts status to "Resident Alien" it is 'permanent' based on continuous residence and a clean criminal record. The 'card' expires after 10 years and can be renewed just as you stated. The reason Diana mentioned that my husband's card will 'be good fr 10 years' is because we've been married for almost 3 years now, so we're past the 2 year 'bonafied' marriage mark. Once we get approved, his card will be issued without the 2 year 'conditions' that most get. The delay of our case will ultimately work in our favor (unbelievable) because we won't have to go through another step in the process after two years and we won't have additonal fees. Furthermore, my husband will be elibible to apply for US Citizenship 3 years later (he can apply after 2 years).

Thank you for the opportunity to write something positive for once.

Ok..earlier I posted a reply concerning my Info Pass appt and now its no there...so just in case its really gone, here's the short story...went, no info, told to wait for the inquiry that's in process. up to 45 days.

That's correct. Their residency status is good for life but the card itself is good for 10 years which can be renewed.

I'm not sure about the I-94 but yes, I've heard that they do take their EAD since it's no longer valid once their permanent residency is approved.

This isn't really an AOS question, but I trust the group here more than going out amongst "strangers". ;)

Lorena's work permit expires in June (after just one year). Does anyone know if we really have to pay the $340 fee???? While we would have no alternative but to get it, that would really suck wind if we had to pay that every year. I looked at the instructions for the I-761 (I think that's the right number) on the USCIS site, but the instructions weren't terribly clear - at least not to me - about whether another fee is necessary.

Thanks for any direction.

I don't believe so because I think you filed after 07/30/07. This is what the I-765 says in the USCIS web site:

If you are filing for an extension of your Employment Authorization and your Form I-485, Application for Permanent Residence, was filed before July 30, 2007, then you must pay the $340 filing fee.

Now you guys know why I'm confused!! haha... Yes, the AOS was approved in September - for only two years. We had applied for and received her EAD before even applying for the AOS. It was valid for only one year and expires in June. I was trying to avoid calling USCIS for the simple reason that I don't trust the info they give on the phone. We went through some of their misinformation a while back and I don't want to repeat it if I can avoid it.

Diana, I guess I missed that somewhere that she doesn't need the EAD after she has the green card. I did find some info on the USCIS site that confirms this. Thanks!!!!!!!!!!! http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

Tony and Diana are correct. They really should have asked you for the EAD at your AOS interview. The good news is no more fees for now.

Ok guys...I got the DUMBEST letter ever on Monday from USCIS. Here goes.

The status of this service request is:

Correspondence, regarding your pending application ,was sent to the NBC. The systems show that....(and HOLD YOUR HATS FOLKS)...your application has not been approved and is still pending (NO ######). Therefore, we request that you schedule an INFOPASS appointment to discuss your pending application with your local District Office.

Honestly, it tickles me that they wasted time generating and mailing this letter to me. I guess we'll try INFOPASS again and take this letter with us. I also mailed the OBUDSMAN a letter on Monday.

What I need right now is OBAMA to step in and help get me some CHANGE.
