Guys, thanks a lot for all your answers. Sorry it took me a while to reply, but happens I just got home back from Colombia with my wife. It was an awesome weekend. Except, maybe, that she already took full ownership of my house and most of my stuff has been displaced to a little corner. I managed to keep the garage, though :blush:

Now, to continue with the questions... on form I-485

1. My wife came to the US through a K3 visa. So on part two (Application type) there are two choices: "An inmigrant petition giving me an immediate available visa number has been approved..." I assume that would be the I-130. I am confused, cause below it reads: "I entered as a K1 fiance of a US citizen whom I married...". Throughout the K3 process, I filled up all the forms as if she was a K1 applicant. Now I am almost sure I should select option one (immigrant petition...), but prefer to verify with you, guys.

2. Which one is her non-immigrant visa number? Is that the one that shows up in her Visa as "Control Number" (14 digits), or is it the one that shows almost by itself on the lower right corner of the visa? (8 digits, font slightly larger than the rest of the information printed on the visa)

3. Finally, just to make sure, her A# is the one the officer wrote on the back of her I-94 at the POE, right?

Sorry if the questions are too basic, but I've learned the hard way that it is much better to ask. Specially having all of you around.

Juan Carlos,

Your wife is legally a non-immigrant until she recieves her green card. Her visa and I-94 will tell you wether she entered as a K3 or K1, but if you are married, then it is undoubtedly a K3. We chose option h. (Other basis of eligibility) on the I-485, and I wrote in the space that she entered with a K3 spousal visa. We never had any problems with that selection.

As for your second question, I'd have to get my wife's passport out of a lock box to look, but I believe the actual visa number is the one in red print. I don't believe it's the control number. There is a link on the AOS forum here that shows exactly where it is. Unless someone else responds with an exact answer, I would start looking at the AOS general forum.

Yes, the A# is the hand-written number on the I-94.

The questions are not too basic. In fact, it seems most of them get asked over and over again (including by me!!!) haha.

Diana, Charles, thanks a lot for your advice. No matter what, they manage to make it confusing, right? Hopefully I'll be able to file for AOS within the next week. I am not sure for K1s, but fot K3s, there ain't much you can't do without the EAD -> social security -> drivers license. So I am hoping I can get past this initial stage soon.

I was reading the instructions on the EAD, and it clearly says I should mail it to an address in Vermont. Is that what you did? Or did you send all the documents in one single package (together with the I-485) to the lockbox in Chicago?

I think I got the answer to my question. I realized I was making a mistake: I should file the EAD as ©(9), not as (a)(9) and send it together with my I-485 to the lockbox. Everything is in the wiki!!

AMEN! I just checked the USCIS website and the processing date for Atlanta is Feb.1...Our petition was recieved around the 7th of Feb, maybe this means we're getting closer. Cross your fingers guys!

PS. Last night I had a dream that the mailman passed by the house and hand delivered the letter from immigration, but it was open and the GC was missing. It was soooooo strange because I've never dreamed about this. Maybe its an omen that the card is on its way.

Hello all, I Almost 8 months after sending the AOS package without RFEs or touches today we made it to the interview. I was really fast and painless the officer hardly asks us questions and said everything was ok. BUT at the end he said that within the next 30 days we need to submit the NEW vaccination sheet??? He said that I did not need a new medical exam but need the form from a USA doctor. Actually he said I would be hard to find a doctor that would be willing to do and charge only for the vaccination sheet. So as soon as I got home I started to contact the "approve doctors" nearby and guess what all of them required me to have the full physical once again!! So that is another 200 bucks!

I am confuse I don't understand how some people get approved with that the NEW vaccination sheet and some don't, well I guess luck. I will let you know when I get my card!!!

Look into the Public Health Dept in your area. Many a times they have Civil Surgeons that will do it for free.

We had a similar situation b/c Oscar had taken his vaccinations and physical one year prior to biometrics. I called all the civil surgeons from the USCIS website in Atlanta and several were willing to update the form for around $25. Keep calling and explain that you don't need the vaccinations, only to have the USCIS form filled out and signed by a Civil Surgeon. Good luck.

It has been a while since I have posted. Sounds like things are moving along for folks, some slower then others.

I made a mistake when I did not bring Paola's son to the US with her at the same time. We recieved notice that he has to have an interview for his GC. They will not let me inturpet for him. I will need to figure out where to get someone for that task.

I should back up some..................I have sold my biz, moved to the Seattle area. We had Paola's interview in Oregon where we were told that we would not need another interview for her son. He is 14 years old. Now I have to provide all the same info as before. Proof of marriage, divorce papers, bank statements ect. I took some time off after selling the biz in March. I have got a job as of the 1st of Aug. Not much employment history and no income for April thru Aug. We were told they will not accept the money I recieve from the sale of my biz as proof of support. Sheesh, he is fourteen. What are they going to do, send him back to Colombia to live on the streets? In the mean time Paola's application for the 10 year GC is comming up in 9 months. More hassel I spose.

March 14, 2006.....We meet, spend the next 2 weeks togeather

May 2006............ I go to see Paola for 5 days and propose marriage

Jan. 24th, 2007....I-129F sent to CSC

Feb. 2nd, 2007.....CSC receives NOA1

June 6, 2007........I-129F Approved

June 6, 2007........Cleared NVC and sent to Bogota

June 12, 2007......I receive packet 3 from our lawyer

June 14, 2007..... I send Packet 3 to Paola via FEDEX (2 day delivery)

June 25, 2007......Paola receives Packet 3 (9 days late)

July 3, 2007.........Packet 3 Fedex to Embassy in Bogota

July 5, 2007.........Packet 3 arrives at the embassy in Bogota

July 19, 2007.......Called NVC, interveiw scheduled for Aug. 17, 2007

July 31, 2007.......Paola goes to US Embassy in Bogota and gets Pkt 4 in person

Hi everybody,

I finally decided to start looking into AOS and I have a few questions. I figured I'd rather ask the Colombia Club usual suspects instead of the VJ community at large. I just prefer the people I've come to like and trust.

First off, I am a bit concerned because I don't think that my wife's POE was handled correctly by ICE. I had always heard that she would be sent to a special office for additional processing. Well, she wasn't. The POE officer didn't speak Spanish and didn't' seem to know what to do so he just stamped her passport and sent her on her way. They didn't even look at her big envelope or give her any other forms. Is this going to cause any trouble for us? If so, what should we do about it?

Also, I am curious as to whether we should wait a while before filing AOS. We were married in June 2007 and my understanding is that if her AOS is approved before June 2009, she will be given Conditional Permanent Residency and will have to file for Removal of Conditions at some point in the future. We aren't in a particular hurry because there is no need for her to work. I suppose the only drawback to waiting is that she can't get a drivers license although there is no big hurry there either. When would be a good time to file AOS to make sure that it is approved after next June and thereby avoid Removal of Conditions?
