Just wondering if anyone has ever cancel their appointment in Bogota to pursue the CR-1 visa instead.

My wife has her appointment for her K-3 visa on October 24th, 2008, and now I wish to pursue the CR-1 visa instead. Both 129f and I-130 where approved at the same time but the I-130 is waiting for an AOS fee ($70) and my wife's choice of agent form.

Any advice will be greatly appreciate it.

I'm pulling for you too! I'm gonna thank you know for your advice and information. We received the interview appointment letter a week before the interview. As we all know, the letter is normally received about a month before the interview date. Today I got a letter from the CIS Ombudsman stating that they initiated a formal inquiry within the USCIS upon receipt of our information. At our interview, the official told us that our time period was not bad at all (for the Hartford Service Center that its!). I almost gagged when I heard this. I can't prove it but I feel like your advice made the difference. Thank you.

Let me start with a quick question... on the vaccines, my wife still needs to take the second TD and Varicella shots. Would you advice me to wait for those shots before filing for the AOS, or can I file with the sheet Dr. Gonzalez gave me, even though it clearly says her vaccines are still incomplete?

I've read two different things about this. Some people only sent in a copy of the vaccination sheet they received from their medical and received their EADs and green cards without any problems. Others said that they received an RFE for the second set of shots. In all honesty, I think the best thing would be to send in what you already have and either wait for the RFE or green card. But before that, make sure your wife doesn't need any of the new vaccines required by the USCIS for AOS:

Rotavirus (children only)

Hepatitis A (not needed unless beneficiary lives in an area where Hepatitis A is easily contracted)

Meningococcal (children 2-18 years of age and people who are or have been exposed to meningitis.

Human papillomavirus (Women 26 years or younger)

Zoster (people older than 60 years-old)

As long as the first dose is administered, it's considered "complete" by CIS for application purposes. You don't even need to receive the other doses, nobody will ever ask you or check if you did. Many people just get the first dose, let the Civil Surgeon mark the form and never go back for the rest.

From CIS website:

Q: Does USCIS require that all shots in each vaccine series be completed before applying for adjustment of status?

No. The applicant must have received all the required age-appropriate vaccines that could be given at the time of the medical exam. If the applicant has started the vaccination series, but is not able to complete all the required shots because, at the time of the medical exam, the minimum time interval between shots has not passed, the applicant may still apply for adjustment of status. A waiver is available in cases where, due to required time intervals, it was impossible for the applicant to receive all shots in the series before submitting the application for adjustment of status.

For example, the Hepatitis A vaccine requires that applicant receive two doses of vaccine, six months apart. If the applicant receives the first dose in January, he or she does not have to wait until July, when the second dose would be given, to submit the adjustment of status application. However, the applicant must have received at least the first dose of the vaccine, if appropriate, before applying for adjustment of status.

From the immunological POV... it makes sense for entering the country relatively 'disease-free'... nevertheless, the boosters are fine-tuning shots to remind your immune system of how to handle these diseases. Interesting the CDC adviced USCIS to focus mainly on the first round of shots and not the whole series.

Hi everyone read the whole forum and have learned alot about AOS. That is the stage we are at. I have a few quick questions.

1. Do I have to submit 325a for only my wife or for both children also? One is 16 the other 10 both here with us. My wife is on a K-1 visa.

2. On the 325a where it says this application is submit in conjunction with an application for? Do I put for my wife K-1 aos?

3. Finally pictures. I am submitting a 485 for all kids and my wife plus 131, 765 for all. How many photos do I need to submit???

Hey congrats to you for getting this far. He is my 2 cents.

1. G-325A for wife and 16 year old stepchild

2. select " Status as Permanent Resident"

3. I filed before the changes in July 2007 but i would provide 2 pictures of each applicant per form as stated in the instructions. This is easy enough to do and eliminates any doubt.

Hello all, I Almost 8 months after sending the AOS package without RFEs or touches today we made it to the interview. I was really fast and painless the officer hardly asks us questions and said everything was ok. BUT at the end he said that within the next 30 days we need to submit the NEW vaccination sheet??? He said that I did not need a new medical exam but need the form from a USA doctor. Actually he said I would be hard to find a doctor that would be willing to do and charge only for the vaccination sheet. So as soon as I got home I started to contact the “approve doctors” nearby and guess what all of them required me to have the full physical once again!! So that is another 200 bucks!

I am confuse I don’t understand how some people get approved with that the NEW vaccination sheet and some don’t, well I guess luck. I will let you know when I get my card!!!

Look into the Public Health Dept in your area. Many a times they have Civil Surgeons that will do it for free.
