Good luck Charles!!!! No worries. It is just another formality.

A word of caution for the Biometrics.

The invite letter states that if you have open wounds or bandaged wounds you may be requested to make another appointment.................................our son broke his arm, his arm is in a cast.............guess what? Need to reschedule the appointment. GRRRRRRRRRRRRRRRRRRRRRRRR. We can do a walk in though so not to bad. We will return after he gets the cast off in about 3 weeks. This will be our third biometrics appointment for him due to a screw up on their part. I am not sure why we were not able to complete the appointment. They seemed to think that he would not be able to give the finger prints properly. All his fingers are exposed and he can move them freely. Sighhhhhhhhhhhhhhhhhhh.

I will be so happy when all this ends for good...............years from now. LOL>LOL.

You are stating Oscar gets the GC it will be a 10 year permanent residence and this time next year he will qualify for USC status.

If I am not mistaken he needs to be an LPR for 3 years on top of the fact that your are married for 3 years. The instructions state Must be one of the following : " A Lawful Permanent Resident for at least three years and at least 18 years old, "

and then it states and

" You have been married to and living with the same U.S. citizen for the last three years,

AND

Your spouse has been a U.S. citizen for the last three years. "

http://www.uscis.gov/files/form/N-400ins.pdf

YOU'RE 100% correct. I read the application (thanks for the link) and he has to be a Resident 3 years prior to applying.. Well, at this point, I'll be satisfied with the Green Card. And YES, he will recieve a 10 year Green Card once its approved because we've been married for more than 2 years now. So at least we don't have to deal with another Fee to "remove conditions". Thanks for correcting me because I've been passing along bad information to a few friends. LOL. By the we, still no 'touches' or news on the AOS process. AGGGGGGG!

Do you think the Info Pass will work? I thought, and may be wrong, that the file goes to California for processing? Will the local office in Atlanta have any info on my case? I guess it couldn't hurt to ask.

Hi campers! We had our AOS interview this morning. Everything went very well. Most of the questions were a bit odd in that the female officer (with another officer as witness) asked us to verify information she had in front of her - full name, birth date, city of birth, parents' names, etc. She also asked how and where we met. All of that went quite well, and she said nothing about needing extra vaccinations before approval.

However...... (why is there always a 'however' with our case???? ).... Though she said our case was approved as far as she was concerned, she said that one of the 'name checks' on Lorena had not been completed yet. Evidently, there are three checks that they do: they do a USA name check (FBI I would guess), a name check in the home country, and a third one internationally through Interpol. It's this third one they are waiting on. She said it could take three to six more weeks, which would put us close to our second anniversary. I asked about the conditional residency issue and she said that it is totally dependent on the approval date. So, theoretically, if you are approved one day before your second anniversary, you will be in conditional status for two years. On or after your second anniversary, you go straight to permanent resident. While she hedged a bit and said it was possible, since we would be so close to our second anniversary, they might go ahead and grant permanent residency, somehow I'm not buying it. We'll just hope that the Interpol check takes longer than normal. In any case, we will be notified when card production is ordered.

So, as always, we have (marginally) good news.

Well, this is interesting. I just checked our case status online at USCIS and this is what they say:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Response to request for evidence received, and case processing has resumed.

I never realized that the AOS interview was effectively considered a 'request for evidence'. If these people weren't so frustrating, this would almost be humorous.

Geez they never do seem to get it 100% with you kids, Charles... what's up with that??

Nevertheless, congrats buddy. I also hope they take a bit longer so you go straight to full residency.

Wishing you ten-fold that which you wish upon all others.

HMMMMM.... What is one to think of our immigration service. The latest chapter in our adventure is a relatively minor one, but sure makes me wonder what the heck these people are thinking about.

We had our interview and the lady said all the paperwork was in order and we were only waiting on a background check from Interpol. However, on Friday we received an ROI for both the boys. Immigration wants a copy of my 864 for each of them. This strikes me as more than odd since the rules clearly state that dependents of the petitioner are included with the proof of support for the petitioner.

I guess if there's a plus side to this, it's that this delay may possibly put card production after our magic two-year anniversary. I would be more than happy for that. But, I still can't believe how incredibly consistently incompetent our government can be.

The only thing I know for sure is that there was no second shooter in the Kennedy assasination and no government plan to destroy the World Trade Center as motivation to wage war on Islam. Our government is totally incapable of any conspiracy more complicated than "hey! let's go screw some things up today."

Okay.... no more venting today. Now it's time to try and catch up with what's been happening here. We were without connection for several days.

I have a question regarding buying airline tickets when the passport and green card are in different names.

I'm trying to buy airline tickets to Colombia. Brianys has her green card, but her passport is still in her maiden name. Avianca requires that the passport and the ticket are in the same name. This is not a problem, however, on the return trip back to the U.S., she will have show her passport which has no valid visa because it's expired, but she now has her green card. I'm not sure if Avianca or Emmigration requires that the passport has a valid visa before being permitted to leave. Will there be a problem passing through Emmigration? Even though her passport and green card show different names, I would think that as long as she showed her passport, marriage certificate and green card to Avianca and to Emmigration then she should be able to pass through and be permitted to leave Colombia. Have any of you experienced this?
