Hello Colombia Club...its been a long time since I posted, but I do check in and read the postings from time to time. Its been a busy 7 months with my husband home. Adjusting to life in the US and life as a married couple has been an interesting experience for both of us. Adding to all of this, is the test of patience the USCIS puts us through as we wait on AOS. It shouldn't be this hard!

We're waiting on Oscar's Green Card or an Interview...we'll settle for the green card :) I don't want to go through another interrogation. Did anyone else in here file their AOS in Feb or March? Just want to see where you are. I haven't had a touch on our file since the EAD.

I'm glad to see the progress that some of you have made in your journey. Scott & Jennifer, congrats! Charles, I think you've had it much worse than me in your journey, but I'm glad to see you've got your family with you now. I hate it that you have to go through the interview in August, but I know you'll do fine.

Good luck to everyone and I'll check in again soon.

I thought of this question yesterday and I know I can count on you guys for an answer. On July 19th, 2008...17 days from today, Oscar and I will celebrate our 2nd wedding anniversary (I can't believe it!!!). If his AOS is approved after the 19th, does he get a 'provisional' green card or does he get his PERMANENT residence???? Does that make sense? BC technically you have to wait 2 years AFTER your married to lift conditions? What do you think CC?

Dre,

I found this in the VJ guides so it looks to me like Oscar will receive a permanent resident card with no conditions if approved after your second aniversary.

A person's permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day they were given permanent residence. A person is also given conditional resident status on the day they are lawfully admitted to the United States on an immigrant visa (having been married less than two years and entering on a CR-1 Visa). A person's permanent resident status is conditional, because they must prove that they did not get married to evade the immigration laws of the United States.

Diana

Hi everyone,

I have not posted in a while. I have been swamped at work. I am not quite in the AOS process, but I am trying to get prepared. Margarita and Daniela's visas were approved in April, but because of my crazy work schedule this time of year, they will not arrive until October 7. I have recently moved, and do not want to change my address with USCIS or department of state until I file for AOS. One of the reasons I chose the village I moved to was for the schools. They have a great Englsih Learning Program here for kids that come from other countries. I need to prove to the school that I live in the village. That is easy enough with utility bills, my driver's license, and lease. The only thing that concerns me is if my old address will be on Margarita and Daniela's visas after POE. The old address is my mom's house (I have always used that instead of changing my address every time I move). Could somebody please tell me if there is an address listed on any of the documents Margarita and Daniela will be given at POE or that are on their visas. It looks like the I94 will have the address on it. Should I try to change the address at POE (I will be with them)? Is there a way to change it beforehand? I called USCIS and they suggested I call the Embassy in Colombia. Until I thought of the problem with the school, I was just going to leave well enough alone and change the address when we file for AOS. Maybe I should just leave it be and explain the situation to the school

Thanks

john

I would call the school first and explain the situation. Maybe your paperwork alone will be enough to proof Daniela's address. If not, then they can advise you on what you can bring to them.

Scott and Diana...thank you for confirming my suspicion. I suspect the delay in the AOS approval may have something to do with that. At least now when we check the mail its in hopes we HAVEN"T gotten anything...until AFTER July 19th!!!! If it works out like this, it will be like the silver lining in our crazy journey. After all we've been through...this will be a nice suprise.

Ok...now to John's question. Let me start off with it being illegal to ask for immigration status for students at most public schools. The school will not ask to see the I-94s or the visas for the kids. Even if they do, those documents are not what is typically used for proof of residency. Our school district has toughened up their requirements this year and they're making every parent sign and notarize an affidavit of residency and their requirement is lease, tax recoreds, utility bills or bank statements. Don't even stress on this any more John. As for changing your address at USCIS, I did it midway in our K3 process and it was very simple, nothing was ever lost or mis-routed.

Good luck.
