Shouldn't the local immigration provide an interpreter? I don't plan to bring any when we go for the interview.

Depends on the interviewer. Some are bilingual... most are not. And you may not be allowed to translate for your spouse...

Or you could get lucky and not need an interview if the AOS paperwork is transferred to CSC from MSC... like in our case.

After reading bunch of posts, I think I will have to hire a Spanish interpreter for AOS interview. I live in San Francisco. Does anyone know a reliable Spanish interpreter which I can hire? Thanks.

Trying to keep on top of things, I've started reading up on "Removing Conditions". Somebody please correct me when I make a mistake in my understanding of the issue.

We've not heard anything back on our AOS yet. According to the USCIS site, as well as some AOS cases I've seen here at VJ, they are currently dealing with February AOS applications. Calculating roughly, I applied at the end of April. That should put our approval (he said with fingers crossed) sometime in August or early September. Our second wedding anniversary is at the end of September.

According to what I am reading, removal of conditions happens automatically if the marriage is at least two years old at the time the AOS is granted. So, does that mean that with a month or less remaining before our anniversary, I would have to shell out another $700+ (this includes biometrics for the boys), when, if I had waited another 30 days or so, it would have cost me nothing? Hope you follow the gist of the question. USCIS has already screwed us out of well over $1000 as it is. I would just be ecstatic if I could give them even more. :blink:

Any ideas of where to look for more info on this?

Hmmm since you guys are K-3 I'm not sure... but I think that the normal frame is 1 year, 6 months post AOS approval to filing for removal of conditions... WITH the subsequent fee payment.

Its removal of conditions based on the GC being valid conditionally for 2 years... so the removal filing is done 6 months before the GC is set to expire.

And you have to file for it... it has little to do with the 2 year wedding anniversary but everything to do with the actual conditional status on the conditional residency. Its not an automatic thing nor is it free. I know... more money out the window.

You may want to call USCIS again with as sweet a customer-service voice as you can... drench whomever responds your call in sugar and try seeing if by extolling their virtues they can speed things up. You may want to do it as an RFE call so as to get yourself a live operator.

I'm pretty sure you're right Charles. Because the USCIS screwed up so much on Lorena's paperwork and is taking so long to process everything, you might miss the 10 year GC by a few months if she gets approved before September. The date on her green card will determine when she will have to remove conditions, which should be in 2010.

I would call the USCIS and ask if she will get her 10 year card if her AOS is approved after September since they've taken so long to process it and since you'll be married two years by then. I'm pretty sure she should get it since that is the whole point of getting a two year conditional green card, to see if the marriage will last longer than two years. You will already have passed that threshold when she gets approved, so she should get her 10 year card and you will save another $545.

Sorry, but she is not in the States yet. We will be filing for AOS either end of September or some time in October. I guess we will see if someone at church can do us this favor to interpret for us when the time comes to have the AOS interview. I am trying to tie all loose ends before hand.

I see your fiancee and my wife did a similar thing... enter POE months after the interview. Mine came in almost 2 months after the interview and she absolutely regrets earning the extra income from her job and not having had a decent summer vacation in Chicago with all its festivals before it got cold.

Hi Charles...I found this info in the guides for removing conditions...hope this helps

Background:

A permanent resident is given the privilege of living and working in the United States permanently. A person's permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day they were given permanent residence. A person is also given conditional resident status on the day they are lawfully admitted to the United States on an immigrant visa (having been married less than two years and entering on a CR-1 Visa). A person's permanent resident status is conditional, because they must prove that they did not get married to evade the immigration laws of the United States.

When to File:

If you are filing jointly, the I-751 form must be filed within the 90 days just preceding the expiration date on your permanent residence card. This is the date that your conditional residence expires. Note that, despite the fact that you may see word "anniversary" used in a confusing way regarding the filing date for removal of conditions, your wedding date is completely irrelevant to determining the window of time during which you may file for removal of conditions.
