Hey Charles that means that someone is touching the files... at least!

Exactly what I was thinking, mavi. The RFE also said that the I-765s for the boys should be processed within 90 days and would be unaffected by the RFE. Got my fingers crossed! :innocent:

Wow Buck, let us know! Hopefully all turned out great and by now you're getting ready with good news. Then its a year and a half more in wait for lifting conditions!

As for the AP... I have it on me at the moment. It clearly states that its good for multiple reentries... did they try to keep it/them??

Yes they kept the one copy that she went to Colombia with. They wanted two copies, we still have the one. I have no idea if you can travel mutiple times on it, I doubt it since thyew kept the original copy. Who knows, everything is different every time. I am getting very weary of all the unexected changes with out notice or, mis information from immigration adn my lawyer. The only good and current advice seems to come from this site. Then it could change at any time. Sighhhhhhhhhhhhhhhhhhhhhhhhh.

The interview today............................I think it was good. We were told we would recieve a decision in 2 or 3 weeks. This seems to be another "new" thing. They do not approve on site. They review the docs and evidence and then send you the decision later. At least this has been the case with me and other clients that my lawyer has had this last week and this week. I see no reason why we should be denied.

We were asked MANY questions about how we met, when we met, the circumstances under which we met and so on. This was a grilling compared to the interview in Colombia. Also Paola was asked the usual questions about being a drug dealer, prostitute, lying to immigration, being here in the US before, aiding any other person to enter the US illegaly and so on. No big deal on any of the questions.

Paola speaks some english, not much, I speak some Spanish, not much. The CO insisted that I not inturpet for her and asked all questions in english. Some Paola did n ot understand, when I tried to tell in Spanish, I was told to not talk. This naturally created some confusion. When Paola was asked where we live, address of our house, she gave our zip code. LOL>LOL>. The CO tried to turn this around as though she did not know where we live. Sheeeeeeeeeeesh. The other wierd thing.............we brought about 50 pics, the pics were of us in Panama, Colombia and the US. When Paola came to the US she put on about 15lbs. When she went back to Colombia she lost the wieght, (tells you something about our food) in the pics the CO asked questions about her having a twin sister, because she looked different. OMFG!!!!!!!!!!!!!!!!!!! Paola told her it was the camara and the way the pic was taken, (in pretty dang good english). In another pic the CO said she looked very different, her hair was not the same!!!!!!!!1??????????? #######!!!!!!!!!!!!!!!!!!!

I asked many questions about why it was not approved at this time and was ignored. I asked what the outcome would be if it was a denial and was told that it would go before a immigration judge and would be determined if deportation was proper or not.

In the end, I consider this to be more BS by immigration due to immigration reform. The CO's are constantly being reviewed on their decisions, and raked over the coals for the few that are wrong. If you can't tell, I am a little pissed off. There is no way my wife is going back to Colombia.

Jan. 24th, 2007....I-129F sent to CSC

Feb. 2nd, 2007.....CSC receives NOA1

June 6, 2007........I-129F Approved

June 6, 2007........Cleared NVC and sent to Bogota

June 12, 2007......I receive packet 3 from our lawyer

June 14, 2007..... I send Packet 3 to Paola via FEDEX (2 day delivery)

June 25, 2007......Paola receives Packet 3 (9 days late)

July 3, 2007.........Packet 3 Fedex to Embassy in Bogota

July 5, 2007.........Packet 3 arrives at the embassy in Bogota

July 19, 2007.......Called NVC, interveiw scheduled for Aug. 17, 2007

July 31, 2007.......Paola goes to US Embassy in Bogota and gets Pkt 4 in person

Aug. 13, 2007.....Lab exam

Aug. 15, 2007.....Medical exam

Aug. 17, 2007.....INTERVIEW!!!!!!!!!!!!!!! Failed cuz of a missing doc. :(

She won't be going back to Colombia. You have plenty of beneficial evidence and it seems you got stuck with a Jerk for an examiner (that's what they call the employees that conduct GC interviews). It has nothing to do with reform in any way since this has been their MO under certain conditions- I suspect the age difference is what set them off this path of questioning. At least you were not denied outright.

You were correct in asking questions throughout the process and I do find it arrogant to be brushed off like you were. There is an appeals process and if it were to come to that, I think you should take into account the examiner's behavior yesterday, even though I doubt it will come to that.

Well I have calmed down now. I was pretty riled up last night. The more time that went by after the interview, the more steamed I got. I expect an approval. The age thing should not make any difference. I do understand that there are chicas that use their charm and look to dupe gringo's, and that is a concern for the CO's. However, Paola is not one of them. I am just growing weary of the whole process. An example is, how many times you have to submit the same doc's, over and over. B-certs and tax returns every time. Why can't these things follow them? Whoops, I'm starting to rant again. LOL>LOL

But yeah... it seems you kids are doing very well... I'd have no big cause for concern. Examiners are just a very special breed of beurocrat, that's all. Just check in on the process as you can over the next couple of days, and do it calmly... hang in there and hang tough...

Hi everybody,

I have a question and i will be thankful if somebody can help me, i marriaged on 04/10/08, we sent all our request for change my status the last May 1st, and i'm planning a trip with my mum to new york for the end of june but the expiration date of immigration in my visa is the next 06/21/08, i wish to know what i have to do for don't be ilegal??? I'm afraid of don't have any document that show that i'm in AOS process.

I apreciate your help.

You should be OK if traveling within the USA.

You should also be receiving the NOA1 acknowledging receipt of the paperwork to have just in case. Sometimes it takes a few weeks. Give it time.

So I just got off the phone with (sigh) a REALLY NICE LADY at CSC... nothing new to update after trying the RFE trick but maybe, just maybe this will get the ball rolling on our approval sans-interview sometime before June.

So, I pretty much just called the national customer service number and followed the prompts as if we had received an RFE. When it goes that way the recording tells you to submit all the required documents (duh), and to hold while I was connected to a live person.

(800) 375 – 5283

The lady I spoke to was really sweet but no new info came out. All I can say is that we don't have an approval notice (or an interview notice for that matter) before June 14 I'll be pushing the 180 day transfer process. Other than that it will be calling a couple of family members that work at USCIS to see if they can ask CSC to get the file off of the desk its sitting on.

Been quite a while since I've stopped by....looks like a lot of the same folks still posting faithfully. Anyway, it's too late to answer the question for Charles, but I'll post a couple of items for some of you folks who are just beginning the AOS process:

1) If your spouse has children and those children came to the U.S. with him/her, you NEED to file the I-130 for the kids. I posted this multiple times before, but apparently there is still confusion. I actually filed the I-130 when my step-daughter was still in Colombia (and paid the old, much lower fee).

2) You don't need to file G325-As for minors. Remember, you didn't have to do it when you filed for the original K visa either.

Good luck to all of you. The AOS process was basically a breeze for us....and the interviewer was very pleasant. By the way, for those of you with a spouse that does not speak much English.....I strongly recommend you bring a translator to the AOS interview. Why risk it? The interview is too important. My wife's English was OK, but not great (it's MUCH better now, almost a year later). We have a local Colombiana friend that we took as our interpreter. IMO, better to take someone like that....than count on your spouse (in our case, me) to interpret for you. I know that in some cases the spouse has been permitted to interpret, but I've also read stories from others where the spouse was not. So, bring an interpreter, even if you have to hire one. Just my opinion.

Forms to complete -

I-485: one for Lorena and each boy (full fee for Lorena, lower fee for each boy under 14)

I-130: one for each boy (I failed to do this the first time around, separate fee required)

I-131: one for Lorena and each boy (fee included with 485 fee)

I-765: one for each boy (fee included with 485 fee) (I submitted this for Lorena last year and she received a few weeks ago) (yes, work permission is needed for children even though they are not eligible to work - they need it to get a Social Security Number)

I-864: only one for Lorena (the boys are covered by her application)

G-325A: only one for Lorena (the boys are covered by her application - I think) HOWEVER!!! This is the one I'm not completely sure about. Anyone know for sure????

We've got the other personal documents and "proofs" ready to go, but I sure don't want to overlook anything after the @* we've gone through for the past year. Any guidance or reassurance will be more than welcome. I've looked for up-to-date comprehensive information on all this and I'm not finding anything outside the USCIS website (generally not helpful when children are involved) that is more recent than January 2007 (before the fee increase), and even some of the pinned information on VisaJourney is out of date.
