Okay.... I have most everything ready to resubmit for Lorena's AOS. Anyone of you folks here who are in the process or have done it WITH CHILDREN involved, please double-check my information:

Forms to complete -

I-485: one for Lorena and each boy (full fee for Lorena, lower fee for each boy under 14)

I-130: one for each boy (I failed to do this the first time around, separate fee required)

I-131: one for Lorena and each boy (fee included with 485 fee)

I-765: one for each boy (fee included with 485 fee) (I submitted this for Lorena last year and she received a few weeks ago) (yes, work permission is needed for children even though they are not eligible to work - they need it to get a Social Security Number)

I-864: only one for Lorena (the boys are covered by her application)

G-325A: only one for Lorena (the boys are covered by her application - I think) HOWEVER!!! This is the one I'm not completely sure about. Anyone know for sure????

We've got the other personal documents and "proofs" ready to go, but I sure don't want to overlook anything after the @* we've gone through for the past year. Any guidance or reassurance will be more than welcome. I've looked for up-to-date comprehensive information on all this and I'm not finding anything outside the USCIS website (generally not helpful when children are involved) that is more recent than January 2007 (before the fee increase), and even some of the pinned information on VisaJourney is out of date.

Well, we sent off what we had and apparently I at least got the dollar amount right as they cashed my check. Here's hoping that the documents and information are what they want. Now we wait for an RFE or an NOA.

I filled the I-765 papers for my husband, I noticed I used the wrong code 6 weeks after we filled and requested an Info pass, we went to the appointment in L.A with the idea they'll be able to make an amendment in the system, I got surprise when the officer told us that the Chicago office will fix it for us, he even told us not to worry about it and to wait the 90 days the work permit requires to be approved, for my surprise, the same day in the afternoon I checked the USCIS on-line case status and his card was ordered. !! His EAD got approved!!

Did the Info pass have something to do? Who knows, his file were never touch until the same day of the appointment.

Actually, a code mistake is an easy one to fix given that the visa status (entry) is what specificies the EAD justifying reason code. ©(9), right?

Nevertheless, congratulations! Now its getting a job that will be the trick!

Finally, indeed! haha.... In what has to be record time for UCIS, we received NOAs for everything YESTERDAY! (I believe I mailed the whole package off around March 14). Lorena and the boys have biometric apointments for April 24 for the I-485s and also for the boys I-765s (so they can get jobs, I guess....just kidding).

Mavi.... Is this when they also do the interview, or is that a separate event? Will I need to bring along our 'proofs' of joint accounts, etc.? I can't imagine it will all happen this fast. But hope springs eternal.

Oh that is a bunch of wishful thinking Charles... Mària's biometrics was (on a postponement) months ago and we received notice that MSC (National Benefits Center) forwarded the I-485 to CSC... so given by the tendency we hope that it would mean NO interview since that would just represent more papers to collect and most likely a day off from work. Not that I don't have an understanding boss or anything, its just that I'd prefer to use my free days for other things.

To answer your question, no... that's not the interview date, IF you guys have to interview...

There was some "RFE trick" some folks were doing here to "inadvertently" bring their application up to the top of the pile and have a faster approval/interview date... but right now I am at OT reading some ludicrous posts... so my search abilities are diminished... maybe someone can fill in?

Anyway, that will be awesome... you can put the boys to work!!! I always tell Mària that our marriage was actually an investment for me... she (I am praying for this) is in the process of getting her psychologist credentials transfered over and that will mean much higher job prospects. Given by some lunatic thoughts people share with the OT thread group, I don't doubt for a second she'll have a lack of people to counsel. J/K on the investment part...

It's been a while since I posted on this forum. Looks like Buck has Paola and her son back to the US. A lot of recent approvals in the K1 forum as well.

Our AOS interview is May 19 and it seems that I may need a third party interpreter for her. From what I have read, the spouse is not allowed to translate for you. Any thoughts?

I could be wrong (I often am), but I was under the impression that USCIS would provide a translator. Even if they don't, I would imagine that in California there should be some Spanish speakers working at the USCIS office. Even here in Kansas City - a long way from the border states - there are Spanish speakers at the USCIS office. One that Lorena talked to the other day was from Mexico but had several friends in and/or from Colombia.

My suggestion would be to contact the national phone line and ask them directly, although they are notoriously poor in the accuracy of their information. Short of that, make an Info-Pass appointment prior to your interview date and simply go in and ask them about translation needs.

I'm sure someone else might have better info than I do.

By the way, Lorena and boys had their biometrics taken the other day. The USCIS office was PACKED!!! There were a bunch of lawyers there and several people were there for deportation hearings. Kind of scary.

A side note: A friend of Lorena's (we met her and her husband at the embassy in Bogota) recently received her green card - WITHOUT an interview!!! She came here on a K-1 visa and they live in Texas. I wasn't aware that was even a possibility, but maybe they are so backed up that they'll grant an AOS without an interview where there is strong evidence of a relationship contained in the application. Anyone hear of this?

Yes Charles, it so happens that there are AOS approvals w/out an interview. It has been suggested that some National Benefits Center transfers to California Service Center receive more interview-less approvals. I certainly hope so since that is where we're at now and we are traveling to Colombia in July on what seems to be AP at the time.

180 days post transfer is in mid June.

So I just got off the phone with (sigh) a REALLY NICE LADY at CSC... nothing new to update after trying the RFE trick but maybe, just maybe this will get the ball rolling on our approval sans-interview sometime before June.

I was abit concerned due to the fact we live in New York and all of her other documents have gone through the Vermont Center. I called, they assurred me that we would not have to travel to California, for an interview, and that more than likely our case had been transferred due to meeting certain criteria, for expedited proccessing? Not totally comfortable with that response, I called the following day (again, getting through to the center) at which time I was told that indeed, not all AOS applicants are required to interview, and also they shift applications to differant locations to "balance the workload" So we are now in the waiting mode.....

Interesting this kind of echoes what I've been told by applicants AND other USCIS personnel. I am going to try to pry some more info out of a couple of family members that work as inspectors.

I HOPE this really means that we get expedited without an interview. Not that it matters much in terms of time since an interview that is approved gets our SO a passport stamp that is as good as the GC itself...

But we got transferred in December and as of yesterday the case was still pending processing at CSC... so I am waiting until June 14 to call again as that is day 180 from transfer to make a stronger claim.

Today is the day we go for the GC interview. 1:30 pm. I am a little nervous but expect things to be ok. P aola has lost her I-94 from when she entered the US. We have copies, hope that works. She has another I-94 that she got when she returned from Colombia.

When she came back going thru Houston POE, they wanted both copies of her AP, she only had the one. Why they would requir both, I have no idea. There was a biot of a hassel but eventully she was allowed to re-enter the US.

I will post the results of her interview later today.

March 14, 2006.....We meet, spend the next 2 weeks togeather

May 2006............ I go to see Paola for 5 days and propose marriage

Jan. 24th, 2007....I-129F sent to CSC

Feb. 2nd, 2007.....CSC receives NOA1

June 6, 2007........I-129F Approved

Wow Buck, let us know! Hopefully all turned out great and by now you're getting ready with good news. Then its a year and a half more in wait for lifting conditions!

As for the AP... I have it on me at the moment. It clearly states that its good for multiple reentries... did they try to keep it/them??

Got an RFE today for the two boys. Seems 'el padraste' forgot to include a copy of his birth certificate with their I-130s. DUH!!

At least it's not any worse than that. The requested info will go out in the mail tomorrow and back to the waiting game.
