Don't worry... hypothetically the K-1 evidence will be in the same manila folder that they will put the I-485 into. Always be prepared for an RFE asking for, you guessed it, evidence, but it should be for things that are easily obtained... bank documents, leases, contracts, etc.

The big thing will be the marriage certificate.

IF you get to interview, then you should be prepared to prove everything with what you were prepared for at the Embassy and then, obviously, more to show the continuation of the relationship.

It's all a matter of choice. Some people send all that stuff with their package and others take it to the interview, if they have one. I for one didn't send anything but my marriage certificate and 2 affidavits from family members when I submitted the I-130 for my husband and was approved without any RFEs. Others send all kinds of evidence including pictures and letters and they were alos approved.

Like Mavi said, just be ready to have all that stuff handy if they send you an RFE requesting evidence.

Hi everyone,

I'll soon be starting on the K-1. My divorce will be final (finally!) on April 4, aka independence day. Anyway, just thought I'd say hi and ask a few basic stoopid noobie questions.

My fiance is in Medellin and I'm in NJ. What's the best (secure/fast/economical) way to send documents, her to me and me to her?

The following is #5 from the K-1 instructions on this site:

"Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example)"

- is this simply a letter that accompanies the K-1?

Last, my fiance speaks virtually no English. Is there any service in Medellin that can help her with the above document and translation in general?

Hi gang. Another update.... we cancelled the appointment with the lawyer because the day before I got a call from my US Senator's office. They had talked with immigration again on our behalf. Basically, the response from USCIS is that we are SOL for applying using the old fees. The lady from the Senator's office said they understood our frustration and hoped to address the kind of stupidity we encountered before the next fee increase. Soooooo.... I am in the process resubmitting our whole AOS package - using the new fees. I fought this fight as long as I dare.

I do have a question, and I am unable to find a definitive answer at the USCIS site or here. Once upon a time, I recall that K-3 visa holders were allowed to travel outside the country without getting the Application for Travel Document (and paying another $300+). Is this still the case? If you know, could you point me to appropriate info on the USCIS site? Lorena wants to visit Colombia this year and we need to know before buying tickets.

All help appreciated, as always.

That being said I thought that with the K3 visa, multiple entries are acceptable? I know on Sandy's K1 it shows on the bottom of the visa page where it says entry - 1. I would check the visa page in the passport, and worse case submit the AP doc. as I said it is included, providing it is submitted with the I-485.

About an hour after I submitted my question, I read the same thing about the AP on the USCIS site. Lorena already has her EAD, so that will not be an issue. As for the multiple entries, I have the same thought....I'm just looking for verification. Thanks for the support!

Hello Glenn,

You need to check out the Colombian Club thread located in the Foreign Embassy forum, I left a name and address of a translator I used in Medellín. He's really good and affordable, located in the Barrio Laureles.

Also, my husband used Deprisa (Avianca) to mail me all the documents I needed. It's a bit pricey but you will get the paperwork within days and delivered to your door via DHL.

Here is some information might help you clear your doubt, my husband is on a K-3 visa and "yes" he can leave as he please for 2 yrs until he gets his AOS approved.

13.6)...I just arrived in the United States as a K3, but if I have an emergency and need to return to my home country, can I return to the United States with no problems using my K3 visa? A..Yes. A K3/K4 is a multiple entry visa, and you may leave the United States and return using the same visa, even if you have applied for Adjustment of Status. Unlike a K1/K2, the K3/K4 does not need to obtain an "advance parole" document to reenter the United States, and applying for Adjustment of Status does not terminate the K3/K4 status.

The invitation letter lists all the docs to bring to the interview................you guessed it, for the 3rd time you have to submit the same stuff again. For the life of me I cannot figure out why these papers cannot follow them thru the process!!!

I assume it was transferred. We recieved instructions on what to bring to the interview and come to find out, they will have much of the info they require you to bring to the interview. Medical, finacial and such. I found out they have a copy of my b-cert and hers, and yet we have to submit them again. Crazy!!

Paola just recieved her SSN, prior to that I was not able to put her on any bank account or insurence policy. Our proof and evidence is pretty weak. Marriage license, a couple of utility bills with her name on them and a checking account. Most of the pics we have are of me or her alone. We have a few of us togeather. I don't see why there should be a problem, but, at the same time.......................

You guys should be fine buck. The repetitiousness in the documents they already have is supposedly to cut down on document fraud, according to an uncle of mine at USCIS that specializes in asylum cases (he previously examined cases).

I asked about CSC transfer because cases that do not require interviews have a higher percentage of transfers to CSC. Its straight to conditional status from that point, according to the trend.
