Timeline
I spoke to soon. My wife received the 2x NOAs today, but when I search for them on the USCIS site it says that it can not find the cases. Has anyone else experienced this problem?

Hi Matt.

I had read a few times in the forum that it's normal not to find your case on line before the Biometrics are done, so, I'm just going to wait a couple of weeks and will try again, I'll post it if it's how it works.

Hi again guys thanks for all the input Lucho, Diana, Scott, and everyone else for that matter. I have got another one for you and I haven't really read anything much about anyone with the same problem. I understand you have to send the I-797C in with the AOS packet...yeah I never really got one of those. I tracked the K1 visa over the USCIS website or phone and recieved niether NOA1 or NOA2. Does anybody have any ideas or can the packet be submitted without this? Thanks again.

25 April 07- I 129F mailed to Texas Service Center

27 April 07- Recieved by TSC

01 May 07- Recieved and assigned case number by California Service Center

27 Aug 07- Recieved notification by email that I 129F had been approved

24 Sep 07- I 129F recieved by NVC

26 Sep 07- I 129F sent to Bogota

09 Oct 07- Pckt 3 recieved by Lina

15 Oct 07- Pckt 3 paperwork faxed to Embassy

23 Oct 07- Pckt 4 recieved by Lina

14 Nov 07- Medical appointments

19 Nov 07- INTERVIEW DAY!!! APPROVED!!!

30 Dec 07- Traveled to U.S. - POE: Orlando

You do need a copy of your NOA2 to send along with your AOS package or you'll receive an RFE. You can do one of the following. Either fill out form I-824 and pay $340 for a copy of the NOA2, or start bugging the USCIS to tell them that it was their fault you never received it, save all this correspondence and send it along with your AOS explaining that it was the USCIS's fault and not yours for you not having this form. :dance::dance: HORAYYYYYYYY!!!!!...We received NOA1 for I485, I131, and I765 :dance::dance:

We were in the same boat as Matt y Fernanda wondering if our paperwork got lost but the check was cashed today and we received 2 each of all three notices also. Kind of weird but we got 6 seperate letters each containing an NOA1 (2 each???)...who knows...at least they're here :thumbs:

Also, is anyone in here in the military? I have a few questions concerning what happens after the AOS if I am put on orders to go overseas again.

Make sure your AOS papers reflect that you are on active duty or in that disposition. I have heard of some spouses facing possible deportation orders after mistakes were uncovered in the AOS paperwork where the active duty spouse could not quckly fix due to being overseas. Hope you don't have to face that while the AOS is in process.

Yes I did on the I-864. We only have to meet 100% of the poverty line. I'm deployed, but I still use my parents address as my mailing address. We've done the entire process so far while I have been deployed. So I hope our luck continues.

Do you know if I need to be at the interview for her AOS?

From what I've read, both spouses must attend the interview for permanent residency. That's where they check your "proof" of relationship (accounts in both names, etc.) and where they ask each of you questions in separate interveiws to compare your responses. From what I have read, this interview can be pretty rough if they think the marriage is phony. I would expect to attend.

Lorena and I finally have a little bit of good news to share. I successfully submitted W-7s for the boys and received their taxpayer ID numbers today. That means we'll get some money back from Uncle Sam, instead of having to pay. Maviwaro, thanks for encouraging me to apply for those. I almost didn't.

Also, we are going to see an attorney this week to try and find out if we have an option to still use the old fees. My guess is "no", but paying him $50 to find out is potentially cheaper than the $1000 extra we'll have to pay under the new fees. Wish us luck!d

Hey Matt I think you're entitled either for a reschedule OR a waiver on attending the AOS interview, IF they put you on the interview list. Lets just say you can hope that they transfer the case to CSC and give her the 2 year residency without any issues. Beware though for the 10 year card. Either way, make sure you include proof of your active duty status and an explananation so as to get them playing ball on your side.

Now I am somewhat confused, I just sent in Sandy and her daughters AOS packages, and followed the steps listed here in VJ.
