Kinda starting the topic again-

Anyone have any issues at SSA with the whole married/maiden name? We got stuck in that limbo but the supervisor informed us that it would only add about 2 weeks to the wait time. Lucky us the SSA office is 5 minutes away from home. She implied that USCIS had not updated the SAVE system name change that they had already changed via the initial AOS paperwork...

Finally I get to join you guys here in the AOS forum!!!!!!!!!!!!!!!!!!

Leidy will be arriving here in New York on Tuesday the 8th!!! :dance::dance::dance:

OK...Here I go....I have a couple of questions that i hope you guys can help me with..

1. Leidy will be entering through JFK...I read here that they issue the EAD stamp there upon arrival..any truth to this?

2. I'm already feeling the pain of having to pay the $1010 for the process, will i have to pay it times 2 ??? Her son??

3. Since it is a K1 visa, will i be able to go get her a SS card, or should i wait until after getting married because of the whole name change issues??

4. Is there a link with all the forms for the AOS process for a K1 visa and do I have to fill out 2 sets?? One for Leidy and one for Daniel??

Should I tell Leidy to hold on to her vaccination record from Dr. Roa for the AOS process??...originally i thought she had to have it for entry to the US and I told her to have them ready for the officer in the airport.

5. What kind of evidence will I need for this leg of the process??

Again I'm soooo glad to be here...thanks everyone!!!!!!!!!!!!!!!!!!!

Hello Byron,

Here we go:

1. Most people at JFK get an EAD stamp that is valid for 90 days.

2. Since Leidy's son received a K2 visa (not a K4) it seems that you will only have to file one I-485 for both of them. (Read page 3 of this thread and you'll see why, but you should also contact the USCIS for clarification).

3. She can get a SS card but it will say that she is not authorized to work unless she has an authorized document from the DHS saying she can. She will then have to go back to change her name and her marital status.

(I don't have a clue about the vaccinations for this process)

5. I would save all the evidence you have now.

1. Yep. As previously stated it is only good for 90 days.

2. I filed under the old fee but it looks like it is $1010 for your wife and $600 for your stepson.

3. Yes she can get a SS as a K-1 holder. You have to wait about 2 weeks after she arrives to apply. This ensures she is in the SAVE system. Be careful to go after 2 weeks because you will most likely not get a number at the 70 day point if you wait. If she does not get a SS while here on the K-1 visa she will have to wait to approval of the EAD.

4. Yep, you will need the vaccination report. You will need a civil surgeon to tranfer the information to the form required for the application. She may need additional shots. Remember a K-1 visa holder does not need a complete physical. Many civil surgeons will insist on giving one. Call around now and find one who is knowledgeable.

As you can see in my time line I'm a K-1 Filler and will have the interview this week coming up. I'm just getting ready for the next step. I've read about bumps getting SS in different States and I don't know how things work in PA. I'm a little confused about the proper order to get things done.

1- get marriage license. Is the passport good enough to get this?

2- get married.

3- wait for 2 weeks. bring marriage certificate. get SS on new name.

4- fill and send out AOS. (on new name too?)

This will depend on PA and local marriage court/county clerk regulations Check with them first.

2- get married.

3- wait for 2 weeks. bring marriage certificate. get SS on new name.

Its usually 2 weeks post arrival as a K-1. SAVE database should be updated by then. 2 weeks post marriage date may be a good idea even though USCIS will not have the new married name on record unless you sent in the AOS package with an explanation of the name change due to marriage. Either way, expect a bump here- my wife is waiting for her number since 4 months after the marriage, already having the EAD in hand, someone at USCIS apparently changed the name from maiden to married but did not update the SAVE database for SSA to verify. The result is a waiting game that coincidentially, we will check with today.

4- fill and send out AOS. (on new name too?)

See answer to #3 above. My recommendation is to send in AOS as early as possible to avoid snags.
