HOla a todos, como estan? yo por aqui ya en los USA, y tratando de descansar un poco.

Chicos, quisiera comentar con ustedes si me pudieran ayudar, es que yo no entiendo muy bien lo del AOS, todavia no me caso, pero necesito saber como es el asunto si me pudieran explicar porfa... es que a ver, tengo unas preguntas:

1. Los 1.010 dolares son para el ajuste de estatus total? o sea incluye el permiso de trabajo tambien?

2. Se puede pagar por separado el ajuste y el permiso de trabajo?

El cheque se debe enviar con que valor? es que algunos me dicen que son 385 dolares, y otras personas me dicen que son 980, ay ya no se, porfa saquenme de la dudita.

Desde finales de julio el total para el AOS es de $1,010 dólares, esto incluye el costo del permiso de trabajo y el AP (Advanced Parole) si necesita salir y entrar al país mientras espera la aprobación del AOS. Pero aunque el precio cubra las tres cosas, ud. tiene que mandar la petición correspondiente para cada una, AOS, EAD y AP.

I posted this in the Colombia forum (and Lucho answered the way I expected), but I thought I'd post it here too.

We've been without internet service for the best part of the past month, so I've had trouble keeping up with happenings here.

A question for you folks: We sent in our AOS paperwork at the end of July - just under the wire for the rate increase. But, we have not received any confirmation, and the check has not yet been cashed. I did receive notification from the post office that the packet had been received, but nothing from USCIS. Anyone else having this experience???? A month seems like a long time to sit on the check, but then again I know they got a crush of applications at the deadline.

Ok, I'm a worrier.... but this IS important - to us, at least. ;-)

Nothing wrong with being a worrier...someone has to....I was the same way. I expect there were many, many folks who submitted AOS documents at the last minute because of the fee increases. I suspect they are merely backed up. At least you have proof that it was received. Not sure what you can do, other than wait a while longer. If they come back and say you need to pay more, at least you have proof that the form was filed before the fee changed. Hope you get the I-797 soon.

I read another post somewhere on here where the VJ member spoke to someone at the USCIS, and she was told that they actually have semis outside each service center with all the petitions they received before the fees were increased and that they don't have the manpower to process them quickly. Now, I don't know if that is true or not but it makes sense to have all those people send it their paperwork to avoid paying more money.

Hey, I sent my paperwork on July 26th, they received it on the 27th (overnight mail service) It took me about a month to get my biometric appt, I just received it last Saturday Sep 1st. But just a few days before that, I called the USCIS and they told me that if I had sent my application in July, it could take up to 90 days to receive a NOA!!! I was in shock, that meant that they were not going to open my package for another 2 months, but lucky for I received the biometrics appt for mid Sep. It is very common that you get your appt before your NOA1, which is weird but that's how they're doing it.

But if you sent it before July 30th you should be alright because according to an update in the USCIS website it says:

"As of August 31, 2007, USCIS has completed data entry and issued receipt notices for applications and petitions received on or before the dates indicated:

Form Number Date Received

I-485 Family Based 7/30/2007 "

For me it seems really a little slow and unfortunate for August filers that paid $1000 and haven't had their applications looked at, but for us that could file before the 30th that's good news!

Well... if the location at the Chicago lockbox is where the semi trucks are supposed to be then someone at USCIS wasn't being completely honest *unless the semis are in a loading dock underground. The Chicago location is actually downtown right next to the Federal Courthouses/ Offices and there are no semi trucks hanging out there.

My 2 cents would be to tough it out a wee bit more- maybe a week or two at the max, and then contact your Congressional offices. I spoke with the folks at Senator Obama's office on a separate issue and decided not to ask them for any further assistance... maybe your Rep could get more done?

Since I am in the post July 30 boat, I truly expect the fee increase to inversely reflect on the handling time, since that was one of their initial justifications in the first place to jack prices up. In other words, I'll wait no longer than 3-4 weeks and then contact my Rep. Goodness luck on my side my best friend in High School is my Rep's nephew.

Or maybe I'm practicing a heck-of-a-lot of wishful thinking?!?!

Based on our experience, I would expect you to get an appointment date later this month. We submitted the forms in early February and had an interview date by later April. The interview date was a little more than two months from the date we got the letter. You wait time will probably be impacted by the local office and how busy they have been.

Hope you hear soon. The AOS process is a lot less stressful/worrisome/paperwork-intensive than the visa process...at least in my opinion.

Well, Corey, you were right that we would hear something soon. We received the rejection notice today along with all of the paperwork. The rejection was because I had not submitted a check based on the new rates, even though our package was postmarked July 28. The package was received in Chicago on July 31, so they are apparently basing the rejection on the date received rather than the date postmarked. This is NOT what I remember the USCIS site saying about the dates. Anyone have any printed evidence about the details of the fee change date?

I will try to reach a live person with the USCIS on Monday. Quite frankly, I don't know how we'll pay the extra fees, if that's what we end up having to do. Lorena can't work yet and because of my job, I can't have a second job without approval. I haven't cried yet, but I'm sure thinking about it. :angry:
