You are correct.  There is no obligation other than to answer the questions truthfully.  CBP should be able to see your pending applications, and they will also see your I94 record showing short visits etc., if they are curious for more, they can ask.  The folks that tend to get in trouble are the ones that come for 90 days (VWP) or six months (B2), leave for a month or so, then attempt to come back.  A friend of mine met someone from Windsor, they crossed the border regularly mostly on weekends (both directions), never had an issue.

This is exactly what I was thinking, I mean... I have done everything right, as far as I know. I go for short trips when i go, I always leave, and never bring checked luggage. I am above board always. The CBP officer at the NEXUS center was basically trying to claim that I commit a violation, whether statutory or policy-wise, in entering as a visitor *regardless of intent*. I have just been churning my mind since about whether I had missed this detail somehow in all my research. So far, the overwhelming consensus of people I speak with seems to be that the CBP officer was incorrect.

Not all CBP is correct, but that one there sound like he trying to make you feel guilty. Just ignore him as you know you got your knowledge right, he don't need to know any more.

Some people just want to say things. I had someone in Brazil getting me pulled aside and in a big trouble for not having a Visa to the USA even when I am a US Citizen - she don't know what she is doing other than causing trouble. zzz

I'm USC, hubby is Canadian. We both have Nexus. We each cross the border monthly, driving through Peace Arch or Pacific Crossing. We've been doing it 10+ years now. All our visits are either weekends, long weekends, or vacations (Christmas is a week, spring break is a week, summer is two weeks). It was nerve-wracking the first few visits after engagement, after the wedding marriage and after the initial I-130 filing. But so far, we've never been turned away. Best of luck to you!
