Hello,

 

A little history,  In the process of submitting Support documents, doctor visit and Interview abroad, etc.  Lived in the states for 29 years, entered with no inspection.  I was 8 years old when I was bought there and had no clue of my status until after I graduated high school at the age of 18.  Since I didn't even remember my birth place and I had started to completely forget the language, I grew accustom to being in the US as all my friends and girlfriends were american.  My US citizen father applied for me in 2013, upon waiting for several years I grew afraid of living in the states in the shadows and didn't want to get deported, so after living there for 29 years and the only country I remember, I went back to my home country of Argentina to wait for my priority date.   (I didn't qualify for DACA cause I was 31 and the age cap was 30).   I finally received the letter from NVC in October 2019, had a few problems paying my fees, but now its taken care of and I'm about to send the other paperwork.

 

The question.  My dad has poor heart health and I want to go back to help him and my mom out.  How do I go about on expediting my I-601?  Can it get approved faster?  I read other people about contacting their local congressmen.  Does this work?

Sounds like you have not had your Consulate Interview, that comes first, presumably you have a 10 year ban and then your Father can file the waiver along with an expedite request.

No I haven't, still in the stage of submitting documents.   Just wanted to ask in advance to get prepared for the I601.   Yes I will have the 10 year ban, the only grounds of inadmissibility.  So my question is when does he expedite the request?  After we send the 601? Before?   How do we expedite it?     Also, does contacting your local congressmen help any?

Who is preparing the waiver package? Essentially the reasons for the expedite in this case are linked.

 

Technically the ban arises when you interview and are found ineligible, so yes you know it is coming and can have your waiver package prepared but not something you can submit until the finding has been made.

I will be preparing the package myself.  I prepared my moms 601A and she got it approved.  I feel confident enough to prepare the 601 as well, but I also have thought about getting a lawyer to help.  My question is how do I expedite it? After submitting it? By calling, email?

You are going to need the receipt notice forst, of course you can assemble your supporting documentation, a Congressperson could help then or possibly the Information sic line or an Infopass, the latter is getting tricky and of course not something you could do.

The receipt notice I get at the interview correct?    Can you elaborate what the sic line or Infopass is?  Haven't heard of this.

 

Was just reading regarding the I-212.  If I left on my own and have zero history with USCIS (not deported, not removed, etc)  Do I need to file the I-212 with the I-601 ?  I'm a little unclear from the instructions on the 212.

When you submit the I 601 you will get a receipt notice.

 

The 1 800 number, has a certain reputation for Misinformation rather than Information.

 

Nothing suggests you need a I 212. Anyway something again for the Consulate interview.

Timeline

After your interview they will give you a blue slip with the waivers you will need to qualify for the visa.

 

File the 601 waiver by mail, I would recommend your mailing address (obviously not physical address) be that of your parents in the US. After 3 weeks you should receive a receipt number.

Hello,

 

Finally just had my interview at the consulate, it went very well, but they found me to be inadmissible based on the 10 year bar under Section 212(a)(9)(B)(2).  Which we already knew.   I'm almost done preparing my paperwork to send.  

 

Have few a questions on filling out the form.

 

*They provided me with a white paper that shows my  reason for being inadmissible.  Do I need to send this page with the I-601?

*The 601 Part 2.  1a to 1d.  has date entered, how you entered and city.  Then 2a to 2e, the same.   But my question is that that 1a to 1d section doesn't have a date departed.  Do I only fill out the 1a to 1d and not the 2a to 2e?

I only entered US once and left once.

*I heard that USCIS is declining forms if they are not all completely with "N/A" and "None" on every box.   So that means I must place a N/A on every empty box, such as Interpreter's name, address, city, as well as  the  Preparer's name, address, etc.  Everything N/A? Also page 11 has health department, physician etc.  All this with N/A on every box ?

*Under Part 4 #40 Inadmissibility statement.  This is where I write myself a background of how I am inadmissible?  Such as was taken to US at a young age etc ?
*Under Part 5 (qualifying relatives) Here I will add my US citizen father petitioner with a statement from me on why my father will experience extreme hardship?  or this has to be a statement from my father on how he will experience the hardship? 
*Under Part 6 (Other relatives) here I will add my Permanent resident Mother.   Again, who writes the statement myself or mother?

*I also have US citizen brother and sister in the US living there.  Can I them also and do I need a statements from each one?

*I also have uncles, aunts, and cousins who have been in the states from the 70's.  Can I and should I add them?

*For anyone I add, do I have to show proof?  like birth certificates, passports, things like that.

 

Last thing my US citizen father and petitioner for me, just got diagnosed with an Aortic Aneurism and requires surgery as soon as possible.  He needs me to be there for emotional and physical support.  I will try to expedite my 601 based on his surgery procedure and health.    Do I just call USCIS, or can I write I dont know, congressmen, president, vice-president or things like this to have it approved on a urgent matter of life or death situation. I want my father to enter the surgery room with me being there waiting for him to get out.

Had another question I forgot to add

 

Part 1 15a.

DOS Consular Case Number.   

 

Is this the Case number at my consulate?  If it is, the whole number with the 3 letters in the front does not fit.

 

Either I only add the numbers or I type it out the complete letters and number in pen after I print?
