Hello. 

My husband and I are waiting for the marriage certificate to send our AOS package (they don't do customer copies anymore where we got married). However it might not get here on time before his legal stay ends. My lawyer said we should send everything before that. Is there a way we could send affidavits from witnesses saying the marriage really happened and send a note saying we will bring the certificate for the interview?

No. The marriage certificate is part of the initial evidence that has to be sent with the application. Failing in doing so could lead to a straight denial since USCIS doesn't even have to send a RFE anymore if something like that is missing in your application.

It does not work that way. Legal stay ends is not an issue if you are filing based on marriage.
