I have a question. On form 134 it wants bank statements (opened, balance, deposits). The second item is and I quote " a copy of the income tax returns".

So they want both my bank statement and my tax return? It does NOT mention a tax transcript. If my tax transcript shows 5X-poverty gross income do they still need my bank statements? Another words my income far exceeds the pov-limit. Do they still need my bank statment from a bank officer?

The I-134 instructions are generic, virtualy all consulates look for the same financial evidense as used for the I-864 form.

That is IRS returns and supporting docs / Letter from employer / Pay Stubs, the bank data is optional and used if income is below the 125% poverty line.

My income is way above the minimum so I kept it simple and For assets I did not list any, so I did not need to provide any asset data like bank statements, IRA or 401K ect.

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. Submit your petitioner's most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included. A completed I-134 Affidavit of

Support Form will be useful to the consular officer to evaluate your petitioner's ability to be financially responsible for you

The K-visas are a non-immigrant visa so use I-134, but have immigrant intent and are processed by the immigrant visa unit at the embassy so things like affidavit of support are held to the same standards as immigrant visa applicants.

Also why not update your profile to show Philippines, Visa type, service center and local office? It helps others answer questions.

I also have an I-134 question, Ephiphany, if you don't mind :blush: the person who is my co-sponsor doesn't yet have the 2006 tax returns, we have copies of his 1040's from 2004 and 2005. And his accountant wrote a letter saying that he had filed for an extension. He is a self-employed writer. It was signed on her letterhead. Does anyone know if this will be enough? Our papers were just forwarded to the embassy Monday, but we probably won't have the 2006 1040 for the interview. Any advice would be very appreciated.

One last question. I can give them the 1040 and transcripts. I am self-employed. I had all my check stubs from customers but they all got wet and ruined in a pipe break incident at my house. Some of the customers checks dont have stubs. So will tax transcripts be enough?

You can always give it a try, it all depends on how picky the consular officer is.

Tax transcripts should be enough evidence, if your personal gross income is that much, you will be fine.

Go back the 3 years, to show steady income.

Manila indicates that Bank statements and letter from employer "MAY" be included, and makes no mention about pay stubs.

I don't know for how long IRS tax transcripts have existed, but I'm sure that I-134 existed long before.

I also don't know when the last time the I-134 instructions were updated (not in the last 5 years, at least), but I do know that the USCIS and its' predecessor INS, keeper of the form, hasn't used I-134 for 10 years now. I would not be at all surprised if the USCIS puts no effort into reviewing and updating the form and its' instructions. (They operated for 8 years on the interim rule for I-864 before finally implementing a final rule!)

They want bank statement only if you provide bank account information. If you don't tell them how much money you have in the bank then you don't need to document it.

When I filed my I-134 I did not supply any tax returns because the form did not ask for any UNLESS I was self employed. I have heard that some consulates request tax returns in the Packet 3 instructions, but, at least in my case, Thailand did not request them either.

Has the form changed in the past few months? I was never asked for nor did I supply any tax returns until the I-864 stage...
