Timeline

Does anyone know long the EAD is good for once you file? I know initially you have 90 days from the entry date but if you actually file then how long do you have? Assuming of course that you filed your AOS.

Actually the EAD isn't good when you file it is only good when it is approved. :)

Timeline

On K-1 if you just file for EAD before filing for AOS, the EAD will be tied to the I-94 card and expire the same time as the I-94 card, (90 days from entry)

If you file for EAD with or after AOS filing, then EAD will be good for 1 year from approval date.

Great. We had planned on filing both at the same time but wanted to make sure about the coverage period. What happens if nothing is approved at the 90-day mark? If she was working would she have to stop or if the case is received and pending does that allow her to continue past the 90-days?

Technically speaking, if she has a gap in employment authorization then she is not authorized to work and would need to stop.
