ADVANCE HEALTH CARE DIRECTIVE FORM vs DURABLE POWER OF ATTORNEY FOR HEALTH CARE

Dear All, I got rfe and ask for ADVANCE HEALTH CARE DIRECTIVE FORM when I look it up online and it said "The Advance Health Care Directive has replaced the Durable Power of Attorney for Health Care (or “DPAHC) as the legally recognized document for appointing a health care agent in California" according to the articles on the website. so if I still use old Durable Power of Attorney for Health Care is that ok since on the rfe paper it ask for Durable Power of Attorney for Health Care. If I use Advance Health Care Directive maybe it will not work? Please help. Thanks

You need to use the legal document for YOUR state.  Each state might call it a different thing.  For example, in Alabama, the person who executes a will is called a "Personal Representative".  In New York, the same person is called an "Executor".  Legal terms when it comes to these documents are regulated by each state.

 

They are essentially the same document, and USCIS will know this.  Again - you need to have the document that is particular to YOUR state.  Don't worry if it is called something different.
