I think we might have made a mistake on our application

We filed for K1 visa yesterday, and I think there's a problem with our application.

I'm adopted - Was born under a name, adopted at only 20 days old, and my name was legally changed through something called "full adoption" here in Argentina.

The problem is that I'm not sure how we're supposed to go about it to begin with, but my fiance didn't put my birth name on my application, and that's because here in Argentina they change your birth certificate so it reflects the name adoptive parents give their children as though it's their birth name - I got mine when I was about six years old.

I'm reading that apparently a birth certificate and a birth act are two different things here in Argentina, and that a birth certificate won't be enough.

Am I going to have to provide both the birth act (that I have actually never had) and the papers explaining the name change? Is our application ruined from this?

 

ETA: I wasn't sure because if I go to request my birth certificate, it shows my name as it is now.

The I-129F asks what other names the beneficiary has used.  Presumably your name at birth through age 6 was noted.

So if the I-129F has already been submitted without this information, is there anything we can do? Or do we just have to wait for an RFE

Wait for the RFE whether it is about this issue or not.  
 

Otherwise correct it at the visa stage.  
 

And don’t repeat the mistake at AOS.  
 

Note that in the USA it is often the case if not usually the case, that birth certificates of adoptees are re-issued with the adopted name. So this should not be unusual to a case officer.

According to the P3 for Argentina this is what is required.

 

BIRTH ENTRY for each visa applicant. Date and place of birth as well as parents’ name must be included in the birth entry.


*If born in Argentina, please submit the Birth Entry (Acta de Nacimiento) issued by the Civil Registry (not the Birth Certificate [Certificado de Nacimiento]). If it is a digitized signed birth entry, please forward us the original email sent by the Civil Registry including the PDF file of the digitized Birth Entry.


*If born in the U.S., Certificates of Birth MUST be original certified long-form copies from the Office of Vital Records from the state where the birth took place. No other birth certificate will be accepted as proof of birth in the U.S.


*If you or any children were adopted, you must submit a certified copy of the final adoption decree.

There is a way to correct a submitted I-129f. Use this letter as your template and return with the information required to correct the error. No need to wait for the RFE.

 

This letter has worked for others to correct errors or for missing documentation or errors that you would like to update, correct or add.

For this, do I have to send in the passport style photo for just my beneficiary? Or should I send one of myself as well. Also do I need to resend the letter of intents? Should I also send in just page 4 of the form which will be updated? Thanks.

Should I also send in just page 4 of the form which will be updated? You can do either. Send a copy of the entire application with the corrected entry or just page 4. Be sure to outline in your cover letter everything that you are sending in detail.

I was adopted at 5 years old by my dad. My last name changed in the united states. no way to get original bc. I applied in 2013 for my sons father and had no problem with the application. Never put my birth name on it. He was denied because he was here for more than a year and banned now for 10 years. I have found a wonderful man in same country and just filed again. But no worries about putting your birth name on the i129

I already sent the photographs with the original submission. The only thing I forgot was the Other Names Used. My question is do i need to send in the photos again with this page 4? Also what should I write on the envelope

If you already sent photos and there are no changes then no need to send again.
