Andrew G. McCabe, the former deputy F.B.I. director and a frequent target of President Trump, will not face charges in an investigation into whether he lied to investigators about a media leak, his defense team said on Friday.

The decision by prosecutors in Washington ends a case that had left Mr. McCabe in legal limbo for nearly two years. It also appears to be a sign that Attorney General William P. Barr wants to show that the Justice Department is independent from Mr. Trump: The notification came a day after Mr. Barr publicly challenged the president to stop attacking law enforcement officials on Twitter and said the criticisms were making his job more difficult.

The prosecutors informed Mr. McCabe’s lawyers of their decision by phone on Friday morning, the lawyers, Michael R. Bromwich and David Schertler, said in a statement.

“We said at the outset of the criminal investigation, almost two years ago, that if the facts and the law determined the result, no charges would be brought,” they said. “We are pleased that Andrew McCabe and his family can go on with their lives without this cloud hanging over them.”

Then why was there an attempt at impeaching Trump with zero evidence, just hearsay?  Why did your party orchestrate THAT particular debacle?

There are plenty of other informed opinions out there from people with reputations as sterling as Mr. McCarthy's. :) Opinions are of course like a plural noun that we cannot say on here -- everybody has one. :P 

 

Ultimately, the DOJ couldn't convince a grand jury to indict McCabe. They had a LOT of time to bring charges, and the judge said you know, you've had enough time to get it together. It's the opinions of the judges and that grand jury that count more than anyone else's, which is how we're here.

Well, the simple fact is McCabe admitted he lied to mislead an investigation which is way more than damaging than anything George P,, Stone, or Flynn did.  Of course now Flynn is walking that back, but it is just another example of a two tier justice system.  For all we know, prosecutor tanked the grand jury on purpose.

Those prosecutors weren't in the bag for anyone but the current administration. They tried and failed. I am always reminded of the saying my dad (and everyone else apparently) says about a prosecutor being able to indict a ham sandwich. I guess Andy McCabe isn't a ham sandwich.

So if it is the case that a prosecutor could indict a ham sandwich, and there was a defendant that admitted to lying to investigators, then by that logic, apparently the prosecutors were incompetent, or the fix was in.  I really doubt all the career federal prosecutors support the current administration.  Heck, didn’t four of them just quit a case based on differences with the administration?

 I am not a lawyer, so most of what I know about the law I learned at the dinner table from my dad. He does civil work, mostly business law, but he's done a couple of fraud defense cases for clients. Anyway, what I understand is that if there isn't enough evidence to bring charges a prosecutor is SOL, even if there's a "confession." My dad talks about building walls of evidence with individual bricks. Confessions are only one of those bricks. On their own they can't be a wall, but they can be part of a wall. You need more bricks, which could be documents or other witnesses. Your wall doesn't need to be big to indict a ham sandwich but it needs to be more than a brick. 

 

The way I think about is this: it's a good thing that our system needs more than a confession to bring charges. Plenty of people who are mentally ill, or covering up for someone else, or looking for attention, or coerced by cops make false confessions. Find something that supports the confession and that confession becomes plausible. I prefer to have a system that has more protections than less personally but that's just me. 😊
