I got a question about I-864 affidavit of Support.

When we filled our AOS in Sep 06 neither my husband nor I had any income. We did not have enough assets to make the poverty line and so we had a co-sponsor. Our lawyer filled out the paper and put all 0 in the filed I-864. After searching for a job for several months I finally got a job 2 weeks ago. Even though my income will not make the poverty line, with my husband’s assets (he owns a house) I believe we should be able to be over the required poverty line.

My questions therefore are.

How do I calculate an asset into the I-864 to find out if we are with my income over the poverty line?

I notice that it says on I-864 sponsor’s income and employment. Those that mean that only the USC can fill the form and only his money counts for the affidavit of support. Or can I put my name and employment in this section?

We have not filed for joint tax returns and my husband has not filed taxes because he has had no income for the last 10 years. Will that be a problem?

Dose the USCIS require that you have to work at a job for a certen time before you can use it in your I-864?

We will still have our co-sponsor for the Interview, but I’m wondering if we should fill out an I-864 and bring it to the Interview in August to show that we are also able to support our self at this time.

Would it just be enough to bring my pay stubs and my husbands property tax form to show my income and his assets to prove self support?

Aug. 12-07 Conditional GC in mail

May 01 -2009 Start of Removing Conditon of Residancy send I-751 off

May. 04-09 I-751 package deliverd at USCIS Vermont

May. 16-09 NOA for I-751

May. 29-09 recived Biometric appointment letter

Jun. 09-09 Biometric Appointment

Oct. 13-09 Letter arrived. Approved

Oct. 26-09 10 Year GC in mail

May 04 - 2010 Start of Natruralization process sent N-400

May 06 - 10 N-400 delivered to Uscis Texas

May 18 - 10 recived NOA

Jun. 14 - 10 Biometric appointment

Aug. 11 - 10 Interview appointment

Spt. 29 - 10 Oath letter asrrived

Oct. 21- 10 I AM AN AMERICAN CITIZEN

If you have your interview already, then why are you worrying about filling out a new I-864?

You're in the home stretch, don't over complicate things now.
