Good day everyone ,I became a US citizen since July 2018.Moved to the states from Nigeria since May 2012..Please am really stranded right now i don't just know what to do...my wife and daughter just received their Visas few days ago in other to join me in the states But my  8months Son who was born abroad (crba) was DENIED crba today ..reason is that am not phisically present in usa up to 5year befor his birth...Pls what do I do now.we cant leav our 8 months baby boy  behind and start coming with wife and daughter, and am currently in Nigeria to bring my wife,daughter and 8 months son to usa..My trips records both in and out of usa show that I have been up to 5 years in usa Which I can still forward the trips record here if possible ..But the interview officer still insists that my present is not up to 5years after going through my Nigeria passports that has stamps of all my trips out of usa..            

I came to usa April 2012 from Nigeria 

I became a citizen  July 2018 

My son was born  May 2019..Please I need help-.Am currently in Nigeria planing to travel back to state with them but this my son case now is given me serious concerns because we can not leav him behind in Nigeria due the amount of insecurity in Nigeria....Please what do we do my 8 months son please...If I should file i-130 form,in texas it takes about 12 to 15months for uscis to send it to nvc.i new what I went through on my wife and daughter's own ..please what can I do now I cant just take my wife and daughter and leav my 8 months son behind So much insecurity in Nigeria very risky to that now.. How many days did you spend outside of the US?

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I think the OP is really in a pickle here. As ban for IV from Nigeria is coming up, it will take a while to get a visa, if one is even granted with a waiver (probably on the more likely side considering its an infant). But on top of that if they dont get a visa for the son within the next 6 months the visas for the other family members will expire

 

OP your wife may need to enter the US to activate her visa and return to Nigeria and hope that the son will get a visa quickly.

From the year I moved to USA which was May 2012 till 2017 ,the days I spent outside US were 512 days had 6 diffrent trips..And from 2017 till my son was born 2019 I also have 2 or 3 trips. I got my CITIZENSHIP July 2018.

All time counts, but it has to be 5 years of actual physical presence in the US.

I don’t understand why you break the period into before and after 2017? What was the total physical time in vs out the US? 512 days is almost one and a half years, and then you mention more trips of undefined length after that, so I can easily believe the actual time you spent was less than 5 years, but you don’t give enough information to be sure.

As noted above, all time within the US counts. This includes time as an LPR, time in status on a visa, and even time spent int he US illegally.
