Hey there, I'm filing a K-1 for the first time and went through one of those K-1 Preparation services and they said I need to include all depositions of past offenses.

 

I have 3 offenses but 1 was when I was 12 about 20 years ago for breaking and entering a Class B felony, but sealed when I was 18, the other 2 are misdemeanors, 1 for Consuming Alcohol in my Apartment as a Minor, and another for DUI but was reduced to Public Intoxication since the vehicle wasn't in Operation.

 

Both of these were 8-11 Years ago. I have depositions for the last 2 but for the first one I was debating on whether or not to even mention it since the County doesn't have electronic records going back that far and couldn't find the paper records. Would I need a statement from them stating such or since I was 12 would I even need to mention it? I don't want to get denied or make it seem like I'm lying.

 

When filling out paperwork for a job I had in the past with a clearance it seemed to be a non issue, just wondering if they would care here?

I heard the rule of thumb from other VJ members is that to declare all past criminal histories and let the CO judge on the merits, rather than  risking them finding out later and deny your petition on the basis of concealing facts. Others can chime in as well. just what I am thinking.

You must disclose it. If you don't mention it, then prepare for a denial.  Immigration is very strict about this.  There is a prominent member here who experienced issues for an expunged record.....The case was denied after the interview......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Gotcha, thanks everyone for the responses. Do I just need to acknowledge/put it down on paper or do I need to try and still get the paper from the court that says I paid the fine/did the community service 20ish years ago as a Minor?

 

If so, since the Court can't find the paper records would I need to get a paper of them with a county seal on it stating as such?
