I came here in September on a k1 fiancé visa and married my wife. I was added to my wife’s NY state of health plan. 3 months Later and I’ve been using it and paying the premium without issue...  they send a letter stating my documentation isn’t proof of lawful presence in the US. I sent my k1 passport visa, my uscis approval notice for my adjustment paperwork. I sent our marriage license and proof of address as I am on the lease we pay for together. I don’t work I’m about 1 month away from my EAD but I don’t think they should be able to kick me off her plan because i don’t have my green card yet. We fully explained I had my I-94 and all of my documents when we added me on and they assured me I as eligible.. I can’t legally leave and I came here in a valid legal visa which means I’m lawfully present as the wife of a Us citizen visa the k1 process. Idk what else to do because the ny state health marketplace isn’t understanding the visa process. It’s clear they aren’t used to dealing with immigrants and they seem clueless.

anyone got any ideas about what is required to prove I legally live here because I’ve sent ridiculous amounts of documents and they seem adamant I can’t have insurance and the market  place at my state of health is the only place to get insurance 😡😡😡

I found this pdf but I'm not sure if it pertains to your health coverage specifically. https://www.health.ny.gov/health_care/medicaid/publications/docs/gis/04ma003att1.pdf

The relevant sections sounds like they're under "Other Persons living in the U.S..." (section I under Category 3) and/or "Special Non-immigrants", which states your I-797 Notice of Action is enough to establish your eligibility under what they call "PRUCOL". Whoever is handling your case definitely has no idea what they're talking about from the sound of it. You need to talk to someone higher up if they're currently giving you nonsense about it.

You are a legend my friend. That is exactly what i told them when I queried it. They point blank said it’s non negotiable. I knew they were lying. Why must it be so hard?
