tax year confusion

Hi 

 

I am filling 864 and have few questions. I haven't file the tax for 2019 yet as i took the extension.  My W2 income is more than enough to prove that i can sponsor.

 

What is most recent tax year 2018 or 2019? I believe 2019 will be most recent after 15APR2020, until 15APR2020 most recent tax year is 2018, correct ?

 

For question "Have you filled the federal income tax return for each of the three most recent tax year?" Should i say yes or no ? If 2019 is most recent then i did filed extension. If 2018 is most recent as of today then i will say Yes. 

 

Most recent, 2nd most recent, and 3rd most recent -> If i am sending my form 864 before 15APR2020 then are they 2018, 2017, 2016 correct?

Taxes aren't due until april 15th.  Take transcripts to the interview for the years that you have and a tax return if you can't download a transcript.

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Than you! In the form should i say yes for the  "Have you filled the federal income tax return for each of the three most recent tax year?" as i filed for 2018, 2017 and 2016.

 

And as of today most recent tax year is 2018 correct?

Yes - it is the required most recent.

During the interview, if it happens post April 2020, the CO may ask for 2020 tax return.

Hi,

 

For me, I did 2016,17,18 because at the time I submitted my paperwork it was Feb 11 2019. When my husband goes for his interview, I will give him those 3 years and 2019; if my tax return is done by then and his interview is after the April 15 date.

You mean to say you submitted your paperwork on Feb 11 2020? and gave 16, 17 and 18 during the 864 submission.

Hi, yes Feb 11 2020

 

Original submission date for us was 11 Dec 2019. Then NVC asked for additional documents including an I-864a from my household member. And that lastest tax return request was 2018 tax return

I did the same thing a year ago, filed for an automatic extension until October 15, so for the I-864 I put the three most recent years for which I had actually filed returns, in April 2019 for me that was 2017, 2016, 2015, with 2017 the most recent year.  I also explained on the I-864 that I had filed for an extension for 2018, and uploaded the 4868 at the NVC stage with the I-864 and financial documents.  By the time of my husband's visa interview in June, we had filed as married jointly with a W-7, so he took the 2018 1040 with all schedules and W2s and was approved with no problems.  Good luck!

Great! I am doing the same, except i will file the tax after her interview as need to include her on tax return and that is easy when she will come here. But i will give my spouse a copy of proof that i took extension and paid the tax already, just need time to file extension, will provide W2 also.

Did you uploaded the 2018 W2s when you submitted I-864?

 

Where you did you explained on the I-864 that you had filed for an extension for 2018? 

 

and you mentioned "uploaded the 4868" was there an option to upload it?

Part 9, "Additional Information" is where I explained I had filed for an extension for 2018 taxes on the I-864.  I uploaded the 4898 as a separate document to CEAC, either as a financial document, or as an additional document, I can't remember.  I did not upload W2s for 2018, since the instructions requested an IRS tax transcript for the most recent tax year, so I uploaded the transcript for 2017.  I did upload the most recent six months of pay stubs and a letter from my employer.
