Custody Issue

My husband is a Canadian citizen with his US permanent residency card. His 16 yr old daughter now wants to live with us, because her mother is verbally abusive. Being 16, we were told she can choose who she wants to live with in Canada.  But we live in the US. If we gain custody, does she have to stay in Canada with her mother until a visa is approved?  His daughter is terrified of her mother and afraid that when she finds out she wants to move with her father it will only be worse for her.

You could try for an expedite, but there is still some time involved.  Is there somewhere else the daughter can stay such as the grandparents, etc.?

Custody will need to be sorted out in Canada, and when it is you need to make darn sure the courts add in that she is allowed to move permanently to the US. For Canada if you do not have a court order on moving her to the US you would still need the mothers permission to take her until she is 18.

You as the USC will file for your step daughter as you were married before she was 18, it will be faster. If her fathers files it can take 2 years before she gets her interview.

When and which visa did your husband enter?
