Hi everybody ! We just got a RFE We are sad and confused !! The RFE say I need to submit my birth certificate but I already did ? I dont understand I should request another birth certificate in my country? mine was a bit old and some words in the back wasnt understable but it was the back where the stamp is . I submit a scan of my copy birth certificate ( I think nobody has the "ORIGINAL" birth certificate, everybody as the "copy certificate" right?)  and a copy of the translation of the front and the back that I paid online in rush translate.com  my birth certificate is the full one  with my parents name and my hospital name and everything .

 Then they said my husband didnt meet the 125 percent of the federal poverty guideline for the petitioning sponsor.. but how we got approve the K1 if he doent meet the income? We submit everything and we know he meet the income . we sent

 

1) Individual income tax return form 1040 for 2018 / 2017 / 2016

2) W2 wage and tax stament 2018 / 2017 / 2016

3) 6 month of pay stubs

4) Tax transcript 2016 / 2017 / 2018 

5) Bank balance

6) birth certificate

7) Passaport biographic page 

 

What we did wrong ?? This happened to someone else ?

Your birth certificate did not meet the standard that USCIS asks for .. if your birth certificate is outdated it is possible that it does not meet USCIS standards.  I cant think of any other reason.

without knowing what the earnings you submitted for I-864 one can only say that USCIS is correct.  they are saying that income does not meet min requirements based on number of people in the household.

But my birth certificate was accepted when we did the k1 visa process? and the k1 visa affidavit of support income isnt the same as the AOS one ? because we are only 2 ...my husband and me same as how we did the k1 visa a couple month ago.

I got an RFE for sending in my joint sponsor's wrong birth certificate. I sent in what was approved for this K1 visa, but it wasn't what they wanted for AOS. And the income needed for AOS is not the same for K1. It's 125% of the poverty line compared to just 100% for the K1. So if you were cutting it close with the K1 visa, there's a chance you don't make enough for AOS

Thanks so so much for your reply !!! We submit the annual household income  of  37.059.00 that isnt enought for AOS for my husband and me, do you know ?

Yes exactly I just checked my husband 1040 from last year and it says that.
