married to US citizen need help visa processing steps

Hello , 

 

Me and MY partner (US citizen) living in Australia . We have been married for the last 8 yrs with 3 children . My partner and Children are US citizen . We have decided to move to USA permanently . There is no US embassy in my city but I sent few emails to US embassy in Australia in regards to visa processing  but never get any reply . Serfing online but get mixed information's regarding the type of visa and other visas during the visa processing time .  Can  you guys help me understand   the steps I need to follow  for the visa .

Are you married?

Timeline

Your spouse will file the I-130 in the US. The process will take 12-18 months

 

Have you done CRBA for the kids and they have US passports? They will need them in order to enter the US

Yes , kids are US citizen , they did CRBA got  the passport . We have visited couple of times in USA .  Can my partner filed for I-30 while living in Australia ? Can we finalize the whole visa processing from here in Australia ? Due to family finance status and other commitments to the children we want to avoid living apart from each other .

Your spouse will eventually need to be domiciled in the US. Some separation can be expected

The best place  to begin to understand the process is to read through information on the USCIS website. You need an IR1 visa .. spouse visa .. it’s an Immediate Relative visa .. the process is started by your husband filing a I130.  This can be done while he is living in Australia.  Once it’s approved .. 10/15 months ., and it goes to the next stage .. NVC.. that’s when he needs to be thinking about returning to the US ahead of you to establish his residency in the US rather than Australia.
