This is the first time I've heard of this, so it may be a processing mistake instead of a new policy. I'm sorry if this has been covered before. A friend who just entered the U.S. on a K-1 after age 26 has just been instructed by USCIS to obtain a letter from Selective Service stating he was exempt from registering for Selective Service before they will process his AOS.

Permanent residents are required to register if they move to the U.S. before their 26th birthday. His one and only entry was after age 26. USCIS has proof of his date of birth and date of entry, obviously, but they still want the letter from SS.

I'm sorry that I don't have more details, but I wanted to share this in case someone runs into the same problem. Anyone dealing with this can request the exemption letter from Selective Service at no charge by following the instructions here:

He can attach supporting documents (copies of I-94, passport, visa) to this form and send it to Selective Service:

The form asks for a Social Security number.

It's a good letter to have on file at home anyway if you are a male conditional or permanent resident who entered the U.S. after your 26th birthday since some agencies will question your failure to register if you apply for federal jobs, student loans, etc. and this letter is easy proof that you were exempt.

08/08/2009........Filed for removal of conditions.

12/16/2009........ROC was approved.

11/05/2010........Eligible for Naturalization.

11/05/2012........Eligible for Naturalization.

He needs it for AOS. USCIS told him he could not adjust status until he sends it to them. I have a feeling someone is confused but this is what he was told.

He needs this letter for AOS or to remove conditions?

I thought K1ers didn't have to register until AOS anyway since those on non-immigrant visas are exempt.
