@zozomike since they’re both under the age of 18, they’re gonna need their father’s permission to immigrate or even travel abroad. And since you guys were not married at the time, this might’ve also been an issue because Sri Lanka has more restrictions when it comes to divorces. It’s best to talk with your now wife and figure out if there were any such circumstances including any court orders against the children traveling and if so to sort that out. This could’ve been a potential for the fiancé visa denial.

Your point is well made, but it is not one we ignored. We filed the biological fathers notarized permission for the children to emmigrate with the fiancee petition, and have again now with the spousal petition. Also the conditions of the divorce awarded full custody to the mother. Not the typical judgement for Sri Lanka evidently.
