Not sure if I should have posted this topic on this forum but I need some advice. So we filed my mom’s taxes separately because she started working last year. A friend of mine was able to claim the money she sent back home for her mom and got some return from it. We also filed my mom’s taxes as single even though she is married because it was asking for SSN for the spouse and dependent. Since my father and sister do not reside in the US yet they do not have SSN that is why we filed her taxes as single. My dad’s and sister’s  petition is pending. Should she be able to claim them because they are technically her dependents and she is sending money back home consistently? We did not use a CPA just tax software from turbo tax.

Really?  Sounds dodgy.  I wouldn't do that.  We also filed my mom’s taxes as single even though she is married because it was asking for SSN for the spouse and dependent. This was an error, and you fix this. She is married and CANNOT file single.  She can file MFS.  You need to amend this ASAP.  Since my father and sister do not reside in the US yet they do not have SSN that is why we filed her taxes as single. Still not okay.  My dad’s and sister’s  petition is pending. Should she be able to claim them because they are technically her dependents and she is sending money back home consistently? NO.  We did not use a CPA just tax software from turbo tax.

She’s not allowed to file as single if married..her taxes will require amending, no, she can’t claim them as dependent because they don’t reside with her

Thank you guys! Yes started filing as married on the process but then, too many questions I could not answer because of the fact that they do not reside here yet. I guess going to h&r block today for amendment. I should have asked here first before we filed and should have just used CPA the first place. 🤦🏻‍♀️
