Hi guys,

 

I have already asked this question but I just wanted to double confirm it just to ensure i'm doing it right. There is a question on the DS-260 that asks if my wife has documentation to show she has vaccinations according to US law. 

 

Do I answer yes because my wife will have that documentation by the time of the interview? 

 

Or no because she doesn't have it yet but explain that she will have it when she goes to St Lukes for her medical? 

 

What's the best answer? Thank you!

Put the correct date and the mistake on the I130 can be explained to the consular officer if asked about it

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

This is the correct answer if you will receive vaccinations at the medical exam.  An answer of Yes would imply that you are fully vaccinated when you send the DS-260.

Yeah that makes more sense to me.

 

Another person mentioned that the ds-260 questions refer to the interview stage, but if so then why wouldn't the ds-260 state that?

I agree, thanks for your help on this.

 

Also my wife and I operated a franchise business with employees in the Philippines but I had forgot to add that as well on the I-130. I was the one who mainly managed the business in the Philippines that's why I forgot I guess. Would that be relevant to add? Thank you!

If she is involved in the business, yes.  In the Philippines, she would be the actual owner of the business.  Right?

Yup that's right, she would be the actual owner. I will go ahead and add it too. I feel bad that I forgot about it.

Actually I had all my vaccinations at this point. I actually asked my lawyer about this one and they said "documentation...in accordance with US law" can only be provided by the panel physician. Your own vaccination documentation does not satisfy the requirement. For example you can not present your vaccinations to the CO directly, it has to be presented to the panel physician who will then certify you have acquired the required vaccines.

They will give my wife her needed vaccinations at the medical exam right? She doesn't have any records of vaccinations from the Philippines either.

I marked yes as I had titre testing proving my immunity or the vaccine info.  But im Canadian.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
