Going to Community College on the K1

Timeline

My fiance is going to come in on Tuesday on the K1, after that we will wait a few days then try to get him his SSN. We plan to get married in 2 weeks (in LA but filing license in Ventura County). The we plan to try to file AOS/EAD/AP asap.

 

I've looked around for answers for this question and it seems to be different depending on the school. I'll try calling tomorrow to ask if they would except a K1 student. He would have to wait until he at least had his SSN to apply, correct?

 

Also, he's taken his GCSE's and 2 A levels in the UK. He's bringing his records with him. From what Ive been readng would it suffice to just have him talk with a college councilor , or does he have to go somewhere to get the USA equivalence sorted out?

 

By marrying me does he also get my status as a California resident , so that he can apply for in state tuition?

 

Any help on the issue or past experiences you had with this situation would be much appreciated. Thank You.

Not usually if they are there legally.   But in California you can get instate if you are undocumented but have proof of an address.  SSN seems to be "optional"

 

You can go to SSA a day or two after and get a SSN.  Sometime it is hard to find someone that knows the rules.

Bingo. What rules they use to determine residency for in-state tuition purposes varies. Since this appears to be a state school, I'm assuming they use state rules.

Your best answers are going to come from the source by calling the Admissions Office about tuition. Don’t expect them to speak fluent K1. Just say he is a new immigrant on a visa, your spouse, and awaiting his greencard which has a lengthy approval time. Have him make an appointment with a counselor to go over his credentials in person.

i dont think instate tution kicks until after being a resident for atleast 1 year in california. 

duh

I believe as undocumented you can even get financial aid for the California system.

Resident

In order to establish residence, it is necessary that there be a union of act and intent.  Students wanting California residency for tuition purposes must present documentation of physical presence and provide objective evidence that they intend to make California their home for anything other than a temporary purpose. (5 CCR 54020)

Students are qualified for California residency for tuition purposes if they have resided in the state for one year prior to the “residence determination date”.  The residence determination date is the day immediately preceding the opening day of instruction. (5 CCR 54002)

A residency classification is made at the time of application.  Students seeking California Residency for tuition purposes will be required to present evidence of physical presence in California, intent to make California their home for other than a temporary purpose and if the student was classified as a nonresident in the preceding term, financial independence.

If a student is over the age of 19, has maintained a home outside of California at any time during the last two years, or has engaged in any other activity inconsistent with making California your permanent home, they will be required to provide additional evidence of intent to reside in California.  Students under the age of 19 derive their residency from their parents.

Students seeking California residency for tuition purposes must also show intent to make California their permanent home.  Evidence of intent to make California a permanent home can be provided in a variety of ways.  There must be an absence of residency from any other state.  Some examples of the evidence you may present is California Driver’s License, the filing of California taxes as a resident, registering to vote in California, showing a California address on federal income tax form, and establishing and maintaining active California bank accounts. (5 CCR 54024)

I concur. I have actually checked several community colleges around me, and all say that you have to be at least 1 year living in CA to qualify for in-state tuition. Out of state tuition is.....insanely high. My plan is actually have my finance enroll in ESL classes at adult education for the first year. Not only it is cheap, but also that he will actually be more prepared for college later.

Not really a waiver. They have to meet the same requirements as everybody else (which does not include immigration status AFAIK).

Yeah the CAL State systems actively caters to out of state and international students because they pay a lot more than in state students do. That's why they have raised the cap the last couple of years of how many out of state students they can admit. This is even after the goal they have gotten over doing exactly that

You definitely want to talk to the schools directly as the decisions will vary by school. As for the SSN, it may not be necessary but again, check with the school.

The college counselor will be able to give you those answers for sure.

No, he doesn't get residency for tuition purposes. As others have said, he will only be considered a resident for tuition purposes after one year of receiving his green card. At least this was my experience at a Cal State University (grad school). Luckily my department was able to give me an out-of-state tuition waiver until I reached that year. Ask the school about what they consider residency for tuition purposes.
